South Korean prosecutors on Monday filed new criminal charges against former President Yoon Suk Yeol, alleging he ordered provocative drone flights over North Korea to deliberately escalate tensions and create a pretext for his controversial martial law declaration.

The indictment adds another layer to South Korea’s most significant political crisis in recent memory, which began when Yoon imposed martial law on December 3, 2024, and deployed troops to surround the National Assembly. He was subsequently impeached, removed from office, and jailed on rebellion charges.

According to a special investigation team, Yoon, former Defense Minister Kim Yong Hyun, and ex-counterintelligence chief Yeo In-hyung now face charges of benefiting the enemy and abuse of power for allegedly authorizing drone flights over Pyongyang in October 2024, approximately two months before the martial law declaration.

“They undermined the military interests of the Republic of Korea by increasing the danger of a South-North armed conflict with the purpose of setting up an environment for declaring emergency martial law,” said Park Ji-young, a senior investigator working for independent counsel Cho Eun-suk.

North Korea had accused Seoul of flying drones over Pyongyang to drop propaganda leaflets three times that month. The South Korean military initially issued vague denials before shifting to a position that it couldn’t confirm the North’s claims—an unusual response given South Korea typically maintains strict secrecy about reconnaissance activities against its northern neighbor.

The alleged drone incursions temporarily heightened peninsula tensions, with North Korea threatening forceful retaliation, though the situation eventually de-escalated without significant military action from either side.

When Yoon declared martial law in December, he briefly referenced “threats from North Korean communist forces,” but predominantly focused on his conflicts with the liberal-controlled parliament, which he characterized as “a den of criminals” and “anti-state forces.” The National Assembly had consistently obstructed Yoon’s agenda, impeached several top officials, and reduced his government’s budget.

Current President Lee Jae-myung, Yoon’s liberal rival who succeeded him after the impeachment, approved legislation establishing independent investigations into Yoon’s martial law declaration and other alleged criminal activities involving the former president, his wife, and associates.

Yoon’s legal team has previously stated that the former president maintains he was not informed about the drone flights. Neither Yoon nor the other two indicted officials have issued public responses to these latest charges.

The new indictments compound Yoon’s legal troubles. In January, state prosecutors had already charged him with directing a rebellion—an offense that carries potential sentences of capital punishment or life imprisonment. Kim and Yeo were also previously arrested and indicted for their alleged key roles in implementing martial law.

Inter-Korean relations deteriorated significantly during Yoon’s administration, which began in May 2022. He adopted a markedly tougher stance on North Korea’s nuclear program compared to his predecessor.
