A Hong Kong court is set to deliver a verdict Monday in the highly anticipated trial of Jimmy Lai, the 78-year-old former pro-democracy media tycoon who faces charges of sedition and collusion with foreign forces under China’s national security law.

The case, which concluded after a marathon 156-day trial, has become a defining symbol of Hong Kong’s transformation in the five years since Beijing imposed the sweeping national security legislation to quell the massive 2019 anti-government protests that rocked the city.

Legal experts, human rights organizations, and foreign governments are closely monitoring the outcome as a critical test of judicial independence and press freedom in the former British colony. Hong Kong was promised it could maintain its Western-style civil liberties for 50 years following its return to Chinese rule in 1997.

Lai, who was arrested in August 2020, has been in custody since December of that year. A self-made businessman who rose from poverty to build a clothing empire before entering media, Lai founded Apple Daily, a newspaper known for its pro-democracy stance and tabloid-style reporting on politics and celebrities.

The publication frequently encouraged readers to participate in protests and Lai himself was a visible presence at many demonstrations, including during the 2019 unrest. Within a year of his arrest, authorities targeted Apple Daily directly, freezing $2.3 million of its assets and arresting senior executives, effectively forcing the newspaper to close. The paper’s final edition in June 2021 sold out all one million copies as supporters rushed to purchase what had become a symbol of press freedom.

Prosecutors have accused Lai of inviting the United States and other foreign powers to impose sanctions on China “under the guise of fighting for freedom and democracy.” A key issue in the trial was whether Lai continued such advocacy after the security law took effect. While Lai admitted to calling for sanctions earlier, his defense maintained he stopped once the legislation came into force.

The prosecution argued that even without direct calls for sanctions after the law’s implementation, Lai attempted to “create a false impression” of China through articles and online broadcasts critical of Hong Kong and mainland authorities, thereby justifying foreign intervention.

Lai’s legal team, led by lawyer Robert Pang, characterized his remarks as merely “armchair punditry” comparable to casual conversations “over the dim sum table.” Pang emphasized that Lai wrote “without any sense of hostility or intention to be seditious” and urged the court to consider freedom of expression in its deliberations.

The prosecution also focused extensively on Lai’s international connections, particularly his meetings with former U.S. officials including Secretary of State Mike Pompeo and then-Vice President Mike Pence during the height of the 2019 protests. Prosecutor Anthony Chau claimed these relationships demonstrated Lai’s “unwavering intent to solicit” punitive actions against China and Hong Kong.

Six former Apple Daily executives previously pleaded guilty in connection with the case in 2022, with some testifying against Lai. Two other alleged co-conspirators linked to the advocacy group “Fight for Freedom Stand with Hong Kong” also provided testimony, though the defense challenged their credibility.

The Inter-Parliamentary Alliance on China, an international group critical of Beijing that was mentioned during the proceedings, has rejected “false claims” regarding Lai’s alleged involvement with their network.

Lai’s case has drawn significant international attention. As a British citizen, his detention has prompted concerns from both the United States and United Kingdom governments, which have called for his release. U.S. President Donald Trump has stated he raised the matter with Chinese officials, while UK Prime Minister Keir Starmer has described securing Lai’s release as a government priority.

Beijing, however, has characterized Lai as “an agent and pawn of anti-China foreign forces” and the “main planner behind disruptive activities” in Hong Kong.

The trial faced several delays, including a postponement after authorities barred a British lawyer from representing Lai, citing potential national security risks.

In August, Lai’s legal team reported he had experienced heart palpitations and required a heart monitor. His children have raised concerns about his deteriorating health, though government officials maintain the medical care he receives in custody is adequate.

If convicted, Lai faces potential sentences ranging from three years for less serious offenses to life imprisonment for “grave” violations under the national security law. Sentencing would likely be determined at a later date, and Lai would retain the right to appeal.

The verdict will serve as a stark indicator of how dramatically Hong Kong’s legal and political landscape has changed since the 2019 protests, with dozens of civil society groups now shuttered and tens of thousands of residents having emigrated to countries including Britain, Canada, Taiwan, Australia and the United States.
