Court rules that suspect in Madeleine McCann disappearance can leave Germany

A German court has ruled that the primary suspect in the Madeleine McCann disappearance can now leave Germany, overturning a key restriction that had been placed on him following his release from prison last month.

The higher state court in Celle partially upheld an appeal filed by Christian Brückner, the German national who has been under investigation since 2020 in connection with the British toddler’s disappearance. The court determined that requiring him to remain in Germany infringed upon European Union citizens’ freedom of movement rights.

Brückner was released in mid-September after completing a prison sentence for an unrelated crime—the 2019 conviction for raping a 72-year-old American woman in Portugal. Upon his release, authorities imposed several conditions that were to remain in place for five years, including electronic ankle monitoring and regular check-ins with probation services.

While the court maintained most of these restrictions, it specifically struck down the requirement that Brückner must reside in Germany. The ruling noted that the lower court in Hildesheim could still impose temporary travel restrictions or prohibit him from visiting specific regions, but the blanket ban on leaving Germany was deemed excessive.

The case of Madeleine McCann has remained one of Europe’s most high-profile missing persons investigations since the three-year-old disappeared from her family’s vacation apartment in Praia da Luz, Portugal, in May 2007. For years, the case saw little progress until German prosecutors announced in June 2020 that they were investigating Brückner on suspicion of murder in connection with her disappearance.

At that time, prosecutors made the significant statement that they believed Madeleine was dead, marking a stark shift from the missing person status that had characterized the investigation for over a decade. Despite this declaration, Brückner has never been formally charged in the McCann case.

Since identifying him as a suspect, authorities have conducted several searches at locations in Portugal where Brückner resided during his years in the Algarve region. These operations have included excavations at a reservoir and examinations of a property where he previously lived.

Friedrich Fülscher, Brückner’s lawyer, has maintained his client’s innocence and pointed to the lack of formal charges despite years of investigation. “If there had been sufficient evidence, charges would have been filed against my client long ago,” Fülscher has stated.

The court’s decision reflects the delicate balance between monitoring individuals under criminal investigation and respecting EU citizens’ right to freedom of movement. The ruling emphasizes that while surveillance measures can be justified, they must be proportionate and respect fundamental EU principles.

The McCann investigation continues to proceed independently of Brückner’s release conditions. Portuguese, British, and German authorities have maintained their commitment to resolving the case, though the investigation has faced numerous challenges over its 17-year span, including jurisdictional complications and the passage of time since the disappearance.

For the McCann family, who have tirelessly campaigned to find answers about their daughter’s disappearance, the legal proceedings surrounding Brückner represent just one aspect of their ongoing search for closure in a case that has captured international attention for nearly two decades.

The court did note that temporary restrictions on Brückner’s movements could still be implemented if necessary for specific investigative purposes, suggesting that authorities retain some ability to monitor his whereabouts should new developments in the McCann case emerge.
