British Political Commentator to Leave US After Detention Over Israel Criticism

British political commentator Sami Hamdi has agreed to voluntarily depart from the United States following more than two weeks in immigration detention, according to an announcement from the Council on American-Islamic Relations (CAIR).

Hamdi, a Muslim commentator known for his analysis of Middle Eastern politics, was arrested by Immigration and Customs Enforcement (ICE) on October 26, just one day after speaking at CAIR’s Sacramento chapter annual gala. His detention came amid increased immigration enforcement actions targeting foreign nationals who have criticized Israel’s military operations in Gaza.

“It is this simple: Sami never should have spent a single night in an ICE cell. His only real ‘offense’ was speaking clearly about Israel’s genocidal war crimes against Palestinians,” said Hussam Ayloush, CEO of CAIR’s California chapter, in a statement released Monday.

According to CAIR officials, the logistics of Hamdi’s departure are still being arranged, though he may leave the country later this week. Zahra Billoo, Executive Director of CAIR’s San Francisco office, emphasized that there are “no conditions to the voluntary departure” and that Hamdi is not prohibited from applying for another U.S. visa in the future.

Tricia McLaughlin, a Department of Homeland Security spokeswoman, confirmed Tuesday that Hamdi had requested voluntary departure and stated that “ICE is happily arranging his removal from this country.”

Hamdi’s case has drawn attention as part of what critics describe as a broader Trump administration initiative to identify and potentially expel thousands of foreign nationals in the United States who allegedly supported protests against Israel or made critical statements about Israeli policies. Civil rights groups have condemned these enforcement actions as violations of constitutional free speech protections, which apply to all persons in the United States regardless of citizenship status.

The Department of Homeland Security previously justified Hamdi’s detention by citing remarks he allegedly made in a video shortly after Hamas’ October 7, 2023, attacks on Israel. In their statement, officials quoted Hamdi asking viewers: “How many of you felt it in your hearts when you got the news that it happened? How many of you felt the euphoria? Allah Akbar.”

Hamdi later clarified that his intent was not to praise the attacks but to suggest that the violence was “a natural consequence of the oppression that is being put on the Palestinians.”

CAIR maintains that the immigration court charging document against Hamdi did not allege criminal conduct or security concerns, but merely cited a visa overstay. The organization claims this overstay resulted from the government’s decision to revoke his visa during his speaking tour.

The State Department has declined to provide specific details about why Hamdi’s visa was revoked, citing “visa record confidentiality.” However, in a post on the social platform X, the department stated: “The United States has no obligation to host foreigners” who the administration deems to “support terrorism and actively undermine the safety of Americans. We continue to revoke the visas of persons engaged in such activity.”

Hamdi’s case has raised concerns among civil liberties advocates about potential government overreach in limiting political speech, particularly regarding the Israeli-Palestinian conflict. It comes amid heightened tensions surrounding discourse about the ongoing situation in Gaza and accusations that criticism of Israeli policies is being suppressed through various government mechanisms.

As Hamdi prepares to leave the United States, questions remain about the implications of his case for other foreign nationals who engage in political commentary critical of U.S. allies while visiting the country.
