British commentator Sami Hamdi returns to UK, considers legal action against US over detention

British political commentator Sami Hamdi returned to the United Kingdom on Thursday, announcing he is considering legal action against U.S. authorities following his controversial detention in an American immigration facility. Speaking to journalists and supporters outside a London hotel near Heathrow Airport, Hamdi claimed his detention was based on his views regarding the Israel-Gaza conflict.

“I want to say that this wasn’t just an attack on me, it was an attack on the freedoms of ordinary Americans and citizens worldwide,” Hamdi stated during his first public appearance since leaving U.S. custody.

The Muslim commentator praised federal judges for what he described as exonerating him after a “botched” detention orchestrated by “extremists” within the U.S. government. His case has drawn significant attention amid growing concerns about free speech limitations surrounding discussions of the Israel-Gaza conflict.

Hamdi was arrested by Immigration and Customs Enforcement (ICE) on October 26, just one day after speaking at the annual gala for the Sacramento chapter of the Council on American-Islamic Relations (CAIR). The U.S. Department of Homeland Security initially stated that the State Department had revoked Hamdi’s visa, prompting his placement in immigration proceedings. Later, authorities accused him of supporting Hamas-led attacks on Israel that occurred on October 7, 2023.

Rejecting these allegations, Hamdi clarified that his intent was never to praise the attacks but to suggest that the violence was “a natural consequence of the oppression that is being put on the Palestinians.” He maintains that his activities in the United States remained within the bounds of his visa permissions.

“I did nothing illegal in the U.S.,” Hamdi insisted. “Everything was within the visa. Everything was in the limits of what the visa allowed me to do. The visa was revoked because of my advocacy for Palestine. It was revoked because of advocacy for Gaza.”

His detention appears to be part of broader enforcement actions by the Trump administration targeting foreigners in the United States who authorities claim have supported protests against Israel’s military operations in Gaza. These actions have sparked significant criticism from civil rights organizations, who argue they violate constitutional protections for freedom of speech—protections that extend to all individuals on U.S. soil, not just American citizens.

While considering legal action, the 35-year-old commentator expressed ambivalence, noting that “cool heads” in the State Department and federal court system ultimately prevailed in his case. “In respect of those cooler heads, I would rather celebrate,” he said. “I won this case, the extremists failed to silence my voice, they failed to remove my freedom of speech. America stood with me.”

Hamdi confirmed that his departure from the United States was voluntary and came without conditions. Importantly, he is not barred from applying for another U.S. visa in the future, suggesting that immigration authorities did not classify him as permanently inadmissible to the country.

The case highlights growing tensions in the United States over speech related to the Israel-Gaza conflict, particularly as the government attempts to balance national security concerns with constitutional protections for free expression. Civil liberties advocates have pointed to Hamdi’s situation as evidence of a troubling trend of using immigration enforcement as a tool to silence political speech that authorities may find objectionable.

As Hamdi readjusts to life in the UK, his experience stands as a flashpoint in ongoing debates about the boundaries of free speech, the treatment of foreign nationals, and the politicization of viewpoints related to the Middle East conflict.
