Portland City Councilor Under Fire for Using False Story to Support Police Mask Ban

Portland City Councilor Sameer Kanal is facing significant backlash after citing a fabricated incident to promote legislation that would prohibit police officers from wearing masks while on duty.

In a controversial Instagram post, Kanal claimed that a masked individual had recently entered a Southeast Portland 7-Eleven, impersonated an immigration agent, and attempted to rob the establishment. However, law enforcement officials quickly pointed out a critical flaw in Kanal’s narrative: the 19-year-old suspect arrested for the crime wasn’t wearing a mask at all.

After being confronted with this discrepancy, Kanal was forced to edit his social media post and acknowledge the error. Despite the retraction, the damage to his credibility had already been done, drawing sharp criticism from local law enforcement representatives.

The Portland Police Association responded swiftly to Kanal’s misrepresentation. Union president Aaron Schmautz condemned the councilor’s actions as “reprehensible” in statements to The Oregonian, suggesting that Kanal deliberately misled the public to advance his political agenda.

“Misrepresenting facts creates significant public discord,” Schmautz said. “The facts are that this individual committed a crime, was not wearing a mask, and was apprehended by law enforcement.”

Despite the factual error in his example, Kanal remains committed to the proposed legislation. He maintains that the fundamental purpose of the measure is valid—to prevent citizens from being intimidated or traumatized by individuals impersonating law enforcement officers. His proposal would prohibit police from wearing masks during operations and require them to display identification badges while performing their duties.

“I think the broader point still holds about the need to ensure that people are not being traumatized by impersonators,” Kanal told The Oregonian, defending the underlying principle of his initiative despite the inaccurate example.

The controversy arrives at a particularly challenging time for such legislation in the Pacific Northwest. While Governor Tina Kotek recently signed a similar statewide measure into law, legal challenges are already mounting. The viability of both the state law and Kanal’s proposed city ordinance has been called into question after a federal appeals court blocked a comparable mask ban in California.

This judicial precedent suggests that Oregon’s version, along with Kanal’s local initiative, could ultimately be ruled unconstitutional. Recognizing these potential legal obstacles, Portland Police Chief Bob Day has requested legal guidance to determine whether the city has the authority to implement such restrictions.

The mask ban represents the latest friction point in the ongoing discourse about police practices and transparency in Portland, a city that has experienced significant tensions between law enforcement and community activists in recent years. The proposal reflects broader national conversations about police accountability and identification during public interactions.

Despite clear signs of constitutional challenges and potential legal deficiencies in his proposal, Councilor Kanal has acknowledged that the wording of his measure may need “adjustment” but remains intent on advancing the legislation to the full city council for consideration this Thursday.

The controversy highlights the complex balancing act between public safety concerns and legal constraints in municipal governance, particularly on issues intersecting with constitutional rights and law enforcement operations. As the proposal moves forward, it will likely face continued scrutiny from both legal experts and community stakeholders concerned about its implementation and effectiveness.
