FBI’s Ballot Seizure in Fulton County Raises Questions About Election Integrity

“I think the end goal is not to use this evidence in any kind of proceeding,” Becker explained. “There’s a real question as to whether or not the DOJ has retained chain of custody on these boxes of ballots that they’ve seized in such a way that they could introduce them into evidence in court.”
Before the FBI’s intervention, Becker noted, the ballots were maintained under strict chain-of-custody protocols with detailed security measures. The disruption of this chain could potentially render the ballots inadmissible in court, suggesting alternative motives behind the seizure.
“Every time anyone has gone into court trying to prove fraud in 2020, they’ve failed,” Becker pointed out. “Oftentimes they’ve conceded that they lied. And here we’re likely seeing that I think the DOJ doesn’t want to go to court, doesn’t want to present evidence, doesn’t want to have it cross-examined and scrutinized.”
Looking ahead to the 2026 election, Becker warned that the seizure could be part of a broader strategy to undermine public confidence in electoral processes. He suggested that efforts to delegitimize elections often signal concerns about potential electoral defeats.
“If you think you’re going to win an election, you don’t devalue or delegitimize that election in advance,” Becker said. “But if you think you’re going to lose an election, that’s when you start seeing disinformation being spread.”
Despite these concerns, Becker expressed confidence in Georgia’s election infrastructure, describing the state’s voter lists as “exceptionally clean” and “the gold standard.” He praised Georgia’s voting accessibility, noting that voters can choose between early in-person voting, mail-in ballots without excuses, or traditional Election Day voting.
When asked about potential federal intervention in Fulton County’s election administration, Becker emphasized constitutional limitations on executive power. “The Constitution is very clear. The founders wrote Article 1, Section 4, the elections clause, into the Constitution, which says that the state legislatures regulate elections,” he explained. “The executive branch, the president, has no authority over elections whatsoever.”
The FBI’s unprecedented action in Fulton County, which is Georgia’s most populous county and typically leans Democratic, continues to draw scrutiny from election experts, legal analysts, and political observers as questions remain about its implications for future elections and voter confidence.
