Hungary’s media landscape is preparing for a significant addition as Szivárvány TV (Rainbow TV), the country’s first television channel dedicated to LGBTQ issues, moves toward launch. According to a report by Magyar Nemzet, the channel’s owners have already submitted the necessary documentation to the National Media and Infocommunications Authority (NMHH) for regulatory approval.

The timing of this media venture comes just days after a landmark ruling by the Court of Justice of the European Union against Hungary’s controversial child protection regulations. The Luxembourg-based court determined that Hungary’s law restricting LGBTQ content violates EU legislation on multiple fronts, particularly provisions related to fundamental rights and the functioning of the internal market.

The court specifically ruled that Hungary cannot restrict the dissemination of what the Hungarian government terms “gender propaganda” in media and advertisements. Additionally, the court found that Hungary’s registry of sex offenders contradicts EU law.

This legal dispute dates back to 2021 when the European Commission initiated proceedings against Hungary, arguing that the country’s legislation violated several EU obligations. The Commission maintained that Hungary’s law not only contradicts the Charter of Fundamental Rights of the European Union but also impedes the free movement of services and violates data protection regulations.

The Hungarian government, led by outgoing Prime Minister Viktor Orbán, has firmly defended its position. Speaking on Kossuth Radio recently, Orbán emphasized the pressure Hungary faces from what he described as “the international gender network.” He stressed the government’s stance that children’s protection must take precedence, stating, “The Hungarian government’s position is that our children come first, and everyone must adapt to this; a clear legal framework must be established in this regard.”

Szivárvány TV plans to operate as both a linear television channel and an online streaming service, broadcasting content 24 hours a day. This hybrid approach aims to combine traditional television programming with the flexibility of modern digital streaming platforms, allowing viewers to access content from anywhere.

The channel is currently awaiting authorization from the NMHH to begin media operations in accordance with EU legislation. If approved, it would represent a significant milestone for LGBTQ representation in Hungarian media, potentially challenging the boundaries of the country’s contentious regulations.

This development occurs against the backdrop of wider political changes in Hungary. Péter Magyar, poised to become the country’s next prime minister, has already begun negotiations with the European Union regarding the release of billions in EU funds that were previously withheld. Magyar faces the complex task of addressing outstanding conditions to secure approximately 35 billion euros for the Hungarian economy.

The emergence of Szivárvány TV highlights the ongoing tension between Hungary’s national policies and EU standards regarding LGBTQ rights and media freedom. While the Hungarian government has maintained its commitment to what it calls child protection, EU institutions have consistently pushed back, viewing these laws as discriminatory against the LGBTQ community.
