Virginia Redistricting Battle Heads to Voters Amid Legal Challenge
Virginia voters will decide Tuesday on a contentious redistricting referendum that could dramatically reshape the state’s political landscape, even as a high-stakes legal challenge before the Virginia Supreme Court threatens to invalidate the entire process.
The referendum, if approved, would redraw Virginia’s congressional map to create what critics describe as a lopsided 10-1 advantage for Democrats in upcoming midterm elections. The legal challenge centers on whether lawmakers violated the Virginia Constitution by keeping a special legislative session open for nearly two years to pass the redistricting measure.
“The voters are the first hope that we have, and the best one,” said Jason Snead, executive director of Honest Elections Project Action, in an interview. Snead warned that if the referendum passes, the Supreme Court decision could be “the last chance” before the next census to challenge the map.
The Honest Elections Project this week submitted an amicus brief to Virginia’s highest court arguing the legislative special session was improperly extended. “If you look at what the Constitution of Virginia requires… it’s very clear that what happened here was an illegally extended special session that essentially turned a part-time legislature into a full-time legislature,” Snead explained.
Virginia Democrats, led by Governor Abigail Spanberger and House Speaker Don Scott, have defended the amendment as a necessary response to redistricting battles across the country. Scott explicitly framed the effort as a counterbalance to Republican gerrymandering in other states when speaking to reporters in February.
“This is about leveling the playing field across the country. Republicans are gerrymandering maps to override the will of the voters,” Scott said at the time. “We just saw it in Texas, North Carolina and Missouri. At Donald Trump’s direction they’re manipulating election maps because they know they can’t win on their agenda in 2026… A 10-1 map levels the playing field.”
The redistricting fight represents a significant shift for Spanberger, who previously criticized gerrymandering practices before backing the current amendment. Critics have accused the governor of hypocrisy on the issue, suggesting political expediency has trumped principle.
In court, Democrats have argued that the General Assembly possesses broad constitutional authority to manage its own legislative sessions and procedures, including extending a special session. They maintain that nothing in the Virginia Constitution explicitly prohibits how this particular session was handled.
Republicans and other critics counter that the process violates both the letter and spirit of Virginia’s constitutional framework for legislative sessions. The extended special session, they argue, represents an unprecedented power grab that undermines democratic norms in the state.
The Supreme Court decided in March to allow the referendum vote to proceed while it considers the legal challenge. “It is the process, not the outcome, of this effort that we may ultimately have to address,” the court wrote. “Issuing an injunction to keep Virginians from the polls is not the proper way to make this decision.”
The stakes are particularly high given the national context of redistricting battles. Across the country, both parties have engaged in aggressive redistricting efforts to secure electoral advantages, with courts frequently stepping in to review the constitutionality of newly drawn maps. Virginia’s case stands out for both the magnitude of the proposed changes and the unusual procedural questions surrounding how the amendment reached the ballot.
Early voting has been underway across Virginia, with signs urging voters to choose “yes” or “no” on the redistricting referendum visible at polling locations statewide. The Supreme Court will hear oral arguments in the case on April 27, with a decision expected sometime thereafter.
If the court ultimately rules the process unconstitutional after voters approve the referendum, it would create significant electoral uncertainty heading into the midterm election cycle and potentially force a return to the current 6-5 congressional district configuration.
Regardless of Tuesday’s outcome, the controversy highlights the increasingly partisan nature of redistricting processes nationwide and raises fundamental questions about legislative authority and constitutional governance in Virginia.
