In a dramatic turn of events following Virginia’s contentious redistricting referendum, a circuit court judge has ruled the entire vote unconstitutional, injecting fresh uncertainty into the state’s electoral map battle.

Virginia Circuit Court Judge Jack Hurley ruled Wednesday—just one day after voters appeared to approve Democrats’ proposed redistricting amendment—that all votes cast in the referendum were invalid. The judge cited constitutional requirements that the referendum allegedly failed to meet, issuing an injunction to block certification of the election results.

“The Tazewell Circuit Court just ruled the referendum unconstitutional. The Judge entered an injunction blocking certification of the election & denied a motion to stay pending appeal,” announced former Republican Virginia Attorney General Ken Cuccinelli on social media platform X following the ruling.

The decision represents a significant victory for Republicans, who have mounted multiple legal challenges to the Democrats’ redistricting effort. Cuccinelli, who heads the American Principles Project Election Transparency Initiative, noted that four separate constitutional challenges are currently making their way through Virginia’s courts, with three specifically targeting the amendment process itself.

Virginia’s newly elected Democratic Attorney General Jay Jones swiftly announced his office would “immediately file an appeal,” characterizing Hurley as “an activist judge” who “should not have veto power over the People’s vote.”

At the heart of the legal dispute is Virginia’s constitutional amendment process, which Cuccinelli explained requires a specific sequence of events. “Virginia has a process to amend its constitution that has the General Assembly pass a proposed amendment and then have a state election—an intervening election—where the new House of Delegates was elected,” Cuccinelli told CNN commentator Scott Jennings.

He argued that Democrats had violated this process, noting, “The General Assembly passed the amendment for the first time—called first passage, very creative—on Halloween. Well, these same Democrats, five years ago, gave us a 45-day election. So, voting began September 19 of 2025. Over a million people had already voted before first passage, and they want to treat that election as the intervening election.”

The stakes are exceptionally high. The approved referendum, if ultimately upheld, could dramatically reshape Virginia’s congressional delegation, potentially giving Democrats a 10-1 advantage, up from their current 6-5 edge. This would represent a significant power shift in a traditionally competitive state that has increasingly leaned Democratic in recent years.

Democratic strategist Adam Parkhomenko expressed confidence that Republicans’ legal challenges would ultimately fail. “Virginia voters spoke. MAGA lost. And now a rogue Republican judge is trying to override the will of the people because they didn’t like the outcome,” Parkhomenko posted on X. “That’s not democracy. That’s desperation.” He added that he has “full confidence a higher court will overturn this nonsense quickly.”

The legal battle highlights the intensifying partisan struggle over redistricting nationwide. While Republicans have traditionally held advantages through gerrymandering in many states, Democrats have increasingly challenged these maps through both legal channels and ballot initiatives promoting “fair maps.”

Cuccinelli indicated he expects this legal process to move rapidly through Virginia’s court system, with a final ruling likely by May 2026. The case could potentially reach Virginia’s Supreme Court, where justices will weigh complex constitutional questions about the amendment process.
