Texas Attorney General Sues ActBlue Over Alleged Deceptive Practices in Political Fundraising

Texas Attorney General Ken Paxton filed a lawsuit Monday against ActBlue, accusing the Democratic fundraising platform of misleading donors about its safeguards against fraudulent and foreign political contributions.

Filed in Tarrant County district court, the lawsuit seeks injunctions to bar ActBlue from accepting contributions made through gift cards and prepaid debit cards, along with civil penalties, attorneys’ fees and costs.

“The radical left has relied on ActBlue as a way to funnel foreign donations and dark money into their political campaigns to subvert our laws and compromise the integrity of our elections,” Paxton said in a statement. “ActBlue lied to Congress and to the American people, and I will ensure justice is served.”

The legal action comes amid heightened scrutiny of online political fundraising platforms during a contentious election cycle. ActBlue, founded in 2004, has processed more than $16 billion for Democratic and progressive candidates and causes, including $1.78 billion in donations in 2023 alone, according to the lawsuit.

Allegations of Misrepresentation

The state’s lawsuit, filed under the Texas Deceptive Trade Practices Act, alleges ActBlue engaged in false, misleading, and deceptive practices by marketing its services as compliant and secure while continuing to allow payment methods that Texas claims can facilitate unlawful donations.

Specifically, the lawsuit contends that ActBlue falsely claimed it had tightened donor-vetting procedures and stopped accepting certain high-risk forms of payment. Texas investigators claim they were able to make donations through ActBlue using gift cards to various Democratic organizations, including the Democratic National Committee and Texas candidates.

The attorney general’s office maintains that gift cards and prepaid debit cards are particularly vulnerable to abuse because they can be used without the same level of identification required for traditional payment methods, potentially allowing foreign donors or those exceeding legal contribution limits to circumvent federal election laws.

Background Investigation

Paxton’s office said the lawsuit stems from an investigation opened in 2023 into whether ActBlue was enabling donor fraud in violation of Texas law. The office later petitioned the Federal Election Commission in 2024, arguing that suspicious actors appeared to be using the platform to make straw donations.

The lawsuit draws heavily on allegations that ActBlue misrepresented its security practices to congressional investigators, claiming it had stopped accepting gift card donations and had implemented multilayered checks to screen for foreign or otherwise impermissible contributions.

“ActBlue claimed it stopped its illegal operations,” Paxton’s news release stated. “Now, recent reporting and internal OAG investigations have shown that ActBlue lied about its donor vetting policies and its operations.”

Congressional Scrutiny

The lawsuit comes amid ongoing investigations by several House committees into ActBlue’s practices. The House Administration, Judiciary, and Oversight committees issued a 2023 report titled “Fraud on ActBlue,” which alleged that the organization had made its fraud-prevention rules “more lenient” twice in 2022 despite awareness of extensive fraud on the platform.

According to the House Judiciary Committee, internal documents showed that “ActBlue executives and staff are aware that both foreign and domestic fraudulent actors are exploiting the platform but do not take the threat seriously. In fact, they attempted to hide the changes to avoid sparking discussions about fraud on the platform.”

Financial Context

The case emerges at a time when campaign finance is under intense scrutiny. The Democratic National Committee reportedly carries more than $17.5 million in debt, according to Federal Election Commission records, highlighting the financial pressures facing political organizations in the current cycle.

Political fundraising platforms have become increasingly critical to campaign operations, processing billions in small-dollar donations that form the financial backbone of modern political campaigns. Any questions about the integrity of these systems could have significant implications for campaign finance practices and public trust in the electoral process.
