Swalwell Resigns from Congress Amid Sexual Misconduct Allegations
Democratic Representative Eric Swalwell of California formally resigned his House seat on Tuesday, abruptly ending his congressional career as he faced mounting sexual misconduct allegations and the threat of potential expulsion from the chamber.
In a resignation letter read aloud on the House floor, Swalwell maintained his innocence while acknowledging he needed to take responsibility for unnamed mistakes. “I will fight the serious false allegations made against me,” Swalwell wrote. “However, I must take responsibility and ownership for the mistakes I did make.”
The congressman’s departure became official at 2 p.m. Tuesday, just one day after he announced his intention to resign without specifying a timeline. His decision came as Florida Republican Representative Anna Paulina Luna had threatened to force a vote on his expulsion if he did not step down voluntarily.
“I am aware of efforts to bring an immediate expulsion vote against me and other members. Expelling anyone in Congress without due process within days of an allegation being made is wrong,” Swalwell explained in his letter. “But it’s also wrong for my constituents to have me distracted from my duties.”
Five women, including one former congressional staffer, have accused Swalwell of sexual misconduct or rape. The allegations have prompted a criminal investigation by the Manhattan District Attorney’s office into at least one incident allegedly occurring in a New York City hotel room. Additionally, FBI Director Kash Patel has invited Swalwell to speak with the bureau regarding the allegations.
Through his attorney Sara Azari, Swalwell has categorically denied criminal wrongdoing. On Tuesday, Azari described the accusations as “false, fabricated, and deeply offensive,” characterizing them as “a calculated and transparent political hit job” against a longtime public servant.
“The timing, nature and coordinated rollout of these vile and heinous allegations speak for themselves,” Azari stated on social media. “This is neither about justice, nor the truth. This is a ruthless and shameless attempt to smear Congressman Swalwell.”
The scandal has devastated Swalwell’s political aspirations beyond Congress. Over the weekend, he suspended what had been a promising campaign for California governor after nearly every prominent Democrat withdrew their endorsements. The rapid abandonment by allies signaled the severity of the allegations and the political calculation that his candidacy had become untenable.
Swalwell’s resignation coincided with that of Republican Representative Tony Gonzales of Texas, whose letter was read immediately before Swalwell’s. Gonzales, who is married with six children, admitted to having an affair with a former staffer who later died by suicide. However, he has not addressed a second accusation of sexual misconduct with another former aide reported by The San Antonio-Express News.
The back-to-back resignations highlight growing scrutiny of congressional behavior as the House grapples with multiple ethics scandals. Before the resignations, Representatives Gonzales, Cory Mills (R-Fla.), and Sheila Cherfilus-McCormick (D-Fla.) had also faced potential expulsion votes for various controversies.
For Swalwell, a six-term congressman who had built a national profile as a fierce critic of former President Donald Trump and briefly ran for president in 2020, the allegations represent a stunning reversal of fortune. Once considered a rising star in Democratic politics, his congressional career has now ended under a cloud of serious allegations that he has vowed to fight.
The California seat Swalwell vacates will likely remain in Democratic hands in the upcoming special election, as the district is considered safely blue. However, the scandal adds another complication for Democrats as they attempt to retake the House majority in November’s general election.
