Border Patrol Documents Reveal Migrant Accused in Loyola Student’s Murder Was Flagged as Flight Risk
Internal Border Patrol documents released Tuesday by the House Judiciary Committee reveal that Jose Medina-Medina, the Venezuelan migrant charged with killing 18-year-old Loyola University student Sheridan Gorman, was flagged as a flight risk with no valid asylum claim before his release into the United States in 2023.
The 25-year-old Medina-Medina is accused of fatally shooting Gorman in Chicago this March, sparking renewed debate over immigration enforcement and sanctuary city policies.
According to the newly released documents, border officials noted significant concerns when Medina-Medina was apprehended at the southern border. “The subject is a migrant illegally present in the United States, have no immigration documents in their possession nor have or anyone else filed a petition on their behalf. Subject has close family ties or roots in this country yet are likely to abscond,” one document states.
Records further indicate Medina-Medina provided no valid U.S. address, carried no identification, and could not offer a verifiable point of contact within the country. Despite these red flags, he was processed for a Notice to Appear and released on his own recognizance, with the documents citing “lack of space” as the reason.
House Judiciary Republicans shared the documents on social media, criticizing immigration authorities for releasing someone they characterized as dangerous despite numerous warning signs.
The records detail Medina-Medina’s border apprehension: “A Border Patrol Agent encountered subject in the El Paso Border Patrol Sector area of responsibility. A Border Patrol Agent determined this subject had unlawfully entered the United States from Mexico, at a time and place other than as designated by the Secretary of the Department of Homeland Security.”
Perhaps most notably, the documents reveal that during processing, “The subject was asked and responded that they do not fear harm or persecution should they be returned to their native country” – indicating he did not express the asylum concerns that might typically justify release pending immigration proceedings.
The case has intensified national scrutiny over immigration enforcement and sanctuary city policies. New York Assemblyman Matt Slater condemned these policies following Gorman’s murder, highlighting the family’s statement that blamed policy failures. Slater also criticized Chicago Alderwoman Maria Hadden, who suggested Gorman was simply in the “wrong place, wrong time,” arguing instead that systemic immigration failures are endangering U.S. citizens.
On April 2, federal prosecutors charged Medina-Medina with illegally possessing a firearm, which carries a maximum 10-year prison sentence. He also faces state charges including murder, attempted murder, aggravated assault, and illegal weapons possession.
According to prosecutors, the shooting occurred in the early morning hours of March 19 at a Rogers Park pier. Gorman was with friends when she spotted Medina-Medina near a lighthouse and warned others. Authorities say Medina-Medina then chased the group and shot Gorman in the upper back as they fled.
Facial recognition technology reportedly played a crucial role in identifying Medina-Medina as a suspect, though some legislators have recently proposed restrictions on such technology that law enforcement advocates say could hamper similar investigations in the future.
The case has become a flashpoint in the ongoing immigration debate, particularly in cities with sanctuary policies that limit cooperation between local law enforcement and federal immigration authorities. Critics argue these policies enable individuals like Medina-Medina to remain in communities despite their illegal status, while supporters maintain they encourage immigrant communities to cooperate with police without fear of deportation.
In a statement following the charges, the Gorman family expressed their profound loss: “Sheridan was a real person—she had a future, a family, and a life full of promise.”
The case continues to draw national attention as both a personal tragedy and a focal point for broader policy debates over immigration enforcement, sanctuary cities, and public safety.
