Former Special Counsel Jack Smith to Testify in Public Hearing Before House Judiciary Committee

Former special counsel Jack Smith is set to testify in a public hearing before the House Judiciary Committee on January 22, following his eight-hour closed-door deposition with the committee last month, according to sources familiar with the matter.

The upcoming appearance will give both Republican and Democratic lawmakers an opportunity to question Smith in a public forum about his prosecutions of former President Donald Trump. During the hearing, House members will question Smith in five-minute increments, a significant departure from the private deposition format where each party had hour-long questioning sessions.

Smith, who was appointed as special counsel to investigate Trump, brought two high-profile indictments against the former president—one related to efforts to overturn the 2020 election results and another concerning the alleged retention of classified documents at Mar-a-Lago. Trump pleaded not guilty to all charges and mounted an aggressive legal defense. Both cases were ultimately dropped after Trump won the 2024 presidential election, with Smith citing the longstanding Department of Justice policy against prosecuting sitting presidents.

During his December closed-door testimony, Smith defended his work and insisted his decisions were made without political considerations. “I made my decisions in the investigation without regard to President Trump’s political association, activities, beliefs, or candidacy in the 2024 presidential election,” Smith stated, according to the deposition transcript. “We took actions based on what the facts and the law required, the very lesson I learned early in my career as a prosecutor.”

The special counsel also addressed the controversial decision to subpoena phone records from numerous Republican senators and House members. Smith maintained that his team followed DOJ policy and emphasized the targeted nature of the subpoenas. “If Donald Trump had chosen to call a number of Democratic senators [to delay the election certification proceedings], we would have gotten toll records for Democratic senators. So responsibility for why these records, why we collected them, that’s — that lies with Donald Trump,” Smith explained.

House Judiciary Committee Chairman Jim Jordan (R-Ohio), who had initially demanded the private deposition, has consistently indicated that a public hearing was also on the table. The upcoming testimony represents a significant moment in the ongoing political and legal aftermath of the Trump investigations.

Trump, who has frequently criticized Smith throughout the investigations, referring to him as a “thug” and suggesting he belongs in jail, has reportedly welcomed the prospect of Smith testifying in a public hearing.

In response to inquiries about the upcoming appearance, Smith’s attorney Lanny Breuer provided a statement: “Jack has been clear for months he is ready and willing to answer questions in a public hearing about his investigations into President Trump’s alleged unlawful efforts to overturn the 2020 election and his mishandling of classified documents.”

The public hearing comes at a time of heightened scrutiny over the Justice Department’s handling of politically sensitive cases. Smith’s testimony is expected to face intense questioning from Republican committee members who have criticized the prosecutions as politically motivated, while Democratic members will likely focus on defending the legitimacy of the investigations into potential wrongdoing.

Legal experts suggest the hearing may provide valuable insights into the decision-making processes within special counsel investigations and the challenges prosecutors face when dealing with cases involving political figures, particularly presidential candidates.
