Fairfax County Prosecutor to Face Congressional Scrutiny Over Immigration Policies

Steve Descano, the Fairfax County, Virginia prosecutor backed by Democratic megadonor George Soros, will make his first appearance before Congress next month as House Republicans question him about the county’s immigration enforcement policies. The hearing comes in the wake of a high-profile murder allegedly committed by an illegal immigrant with a lengthy criminal history.

Descano and Fairfax County Sheriff Stacey Kincaid are scheduled to testify on May 14 before the House Judiciary Committee’s immigration subcommittee. The hearing, titled “Fairfax County, Virginia: The Dangerous Consequences of Sanctuary Policies,” will examine whether the county’s limited cooperation with federal immigration authorities poses public safety risks.

At the center of the controversy is the case of Stephanie Minter, a Fredericksburg mother who was fatally stabbed at a Fairfax County bus stop earlier this year. Abdul Jalloh, a Sierra Leone national who allegedly killed Minter, had reportedly been arrested 30 times before the murder, according to the Department of Homeland Security.

Congressional Republicans argue that Fairfax County’s policies and Descano’s prosecutorial decisions allowed Jalloh to remain free despite multiple encounters with law enforcement. Police records show that Fairfax County officers had warned Descano’s office about Jalloh’s potential for violence, with one officer explicitly cautioning that it was “not a question of if, but rather when he will maliciously wound (or worse) again.”

The tragic case has sparked multiple responses. Minter’s family is now supporting a recall effort against Descano, according to local media reports. At the federal level, Republican lawmakers are using the case to push for potential reforms targeting sanctuary jurisdictions.

Descano has received substantial campaign support from progressive sources, including more than $600,000 from the Justice and Public Safety PAC, a committee primarily funded by Soros that supports progressive prosecutors across the country. During his campaign, Descano criticized what he described as a two-tiered justice system that disadvantaged non-citizens who faced both criminal penalties and potential deportation.

“CA Descano is looking forward to the opportunity to discuss Fairfax’s record as one of the safest large jurisdictions in the country,” his office told media outlets when asked about the upcoming testimony.

The hearing will likely focus not only on the Minter case but also on broader policies. House Republicans have previously criticized Fairfax County plea deals involving non-citizens, including a high-profile 2024 murder case where two defendants received five-year sentences. Critics link these outcomes to what they characterize as Descano’s deliberate avoidance of immigration-related consequences.

Sheriff Kincaid, who will also testify, faces separate scrutiny for her department’s policies regarding Immigration and Customs Enforcement (ICE). Kincaid has declined to honor ICE detainers, instead requiring judicial warrants before transferring inmates to federal custody after they leave local jails. Federal officials have argued this requirement conflicts with ICE’s standard operating procedures.

The May 14 hearing represents a significant escalation in federal oversight of local immigration enforcement policies. While Descano has previously testified at state-level hearings, including before the Virginia Senate Judiciary Committee, this marks his first known appearance before a congressional committee.

The upcoming testimony comes amid heightened national debate about immigration enforcement, sanctuary policies, and the role of local prosecutors in navigating these complex issues. As both sides prepare their arguments, the hearing is likely to further intensify discussions about the balance between local control of law enforcement and federal immigration priorities.
