Rep. Eric Swalwell Files Lawsuit Against Federal Housing Official Over Privacy Concerns

California Democratic Representative Eric Swalwell has filed a lawsuit against Federal Housing Finance Agency (FHFA) Director Bill Pulte, accusing him of illegally accessing private mortgage records of Democratic politicians and using the information to trigger federal criminal investigations.

The lawsuit, filed Tuesday in federal court in Washington, D.C., alleges that Pulte “abused his position” to obtain mortgage records of numerous Democrats who are known critics of President Donald Trump. According to Swalwell, Pulte then used this private data to make criminal referrals to the Department of Justice (DOJ).

“Today I have filed a civil lawsuit against FHA Director Bill Pulte for violating the Privacy Act and First Amendment,” Swalwell said in a statement. “Director Pulte has combed through private records of political opponents. To silence them.”

The lawsuit comes just days after the Department of Justice opened an investigation into Swalwell on November 13 over alleged mortgage fraud. According to court documents, Pulte claimed in his referral that Swalwell falsely represented his Washington, D.C. home as his primary residence on mortgage documents to secure more favorable loan terms.

Swalwell vehemently denies these allegations, describing them in his lawsuit as “patently false” and “a gross mischaracterization of reality.” His legal team argues that the FHFA lacks the authority to obtain, use, or leak private financial data belonging to elected officials.

The timing of the investigation is particularly significant as Swalwell recently announced his candidacy for California governor in the 2026 race. In his lawsuit, Swalwell claims that the release of his personal information has damaged his reputation ahead of his gubernatorial campaign and forced him to “expend personal resources” fighting the DOJ probe.

The congressman also expressed security concerns, stating that “widespread publication of information about the home where his wife and young children reside has exposed him to heightened security risks and caused him significant anguish and distress.”

The lawsuit suggests a pattern of political retaliation, pointing to similar referrals made by the FHFA involving other prominent Trump critics, including New York Attorney General Letitia James, Senator Adam Schiff (D-Calif.), and Federal Reserve Board member Lisa Cook. Notably, a federal judge dismissed the indictment against James just a day before Swalwell filed his lawsuit.

Housing industry experts note that this unusual conflict raises questions about the independence of federal agencies and the potential politicization of regulatory bodies. The FHFA, created in the wake of the 2008 financial crisis, oversees Fannie Mae and Freddie Mac and has access to vast amounts of mortgage data on American homeowners.

“These allegations, if proven true, would represent a serious breach of the firewall that should exist between politics and the administration of crucial financial oversight agencies,” said one housing policy analyst who requested anonymity due to the sensitive nature of the case.

Swalwell’s lawsuit claims that Pulte’s actions were “a purposeful attack on core democratic norms” that reflect “a base desire to achieve exactly what the First Amendment and the Privacy Act exist to prevent: the use of government machinery to chill and silence the government’s critics.”
