As Senator Rand Paul’s criminal referral against Dr. Anthony Fauci reaches its statute of limitations deadline, the Kentucky lawmaker continues to press for justice in what he calls “the COVID coverup.” The five-year window for prosecuting Fauci for allegedly lying to Congress about gain-of-function research expires Monday, despite Paul’s persistent calls for the Department of Justice to act.

“David Morens, Dr. Fauci’s top advisor, was indicted, but Fauci himself still walks free,” Paul wrote on social media this week, highlighting that the DOJ has mere days remaining to bring charges before the statute of limitations runs out.

The criminal allegations stem from Fauci’s May 2021 congressional testimony, where he stated that “the NIH has not ever and does not now fund gain-of-function research in the Wuhan Institute of Virology.” Paul contends this statement directly contradicted evidence, including a February 2020 email in which Fauci himself acknowledged that “scientists in Wuhan University are known to have been working on gain-of-function experiments.”

Fauci, who served as director of the National Institute of Allergy and Infectious Diseases (NIAID) and chief medical advisor to President Biden, received a controversial preemptive pardon on January 19, 2025, during Biden’s final day in office. This pardon has further complicated matters, with the Trump administration questioning its legitimacy, particularly as it was reportedly authorized via autopen.

While Fauci may escape prosecution, his former senior advisor David Morens was indicted late last month for allegedly “deliberately concealing information and falsifying records in an effort to suppress alternative theories regarding the origins of COVID-19.” This indictment has fueled Paul’s argument that a broader cover-up existed within Fauci’s inner circle.

“For years, I warned that Fauci and his inner circle buried the truth about Wuhan,” Paul wrote. “Now his closest adviser has been indicted.”

The core of the dispute centers on the definition and funding of gain-of-function research, particularly studies conducted at the Wuhan Institute of Virology. Paul’s criminal referral cites research at the WIV that was “funded under a NIAID award and involved combining spike genes from bat SARS-related coronaviruses with another coronavirus backbone to create chimeric viruses capable of infecting human cells.”

A 2023 Government Accountability Office report lends weight to Paul’s claims, finding that NIH funded a project that included “genetic experiments to combine naturally occurring bat coronaviruses with SARS and MERS viruses, resulting in hybridized coronavirus strains.”

Throughout multiple congressional hearings, Fauci has vehemently denied lying, telling Paul directly, “Sen. Paul, I have never lied before the Congress, and I do not retract that statement.” In one particularly heated exchange, Fauci told Paul, “You do not know what you’re talking about, quite frankly. And I want to say that officially.”

Not content to let the matter drop despite the expiring statute of limitations, Paul has scheduled a Senate Homeland Security & Governmental Affairs committee hearing for Wednesday, May 13, featuring testimony from a “COVID coverup” whistleblower. “The truth is coming,” Paul promised.

The legal and political standoff highlights continuing divisions over the pandemic response and COVID-19’s origins. While members of Congress like Paul enjoy immunity under the Constitution’s speech and debate clause, witnesses who testify under oath, as Fauci did, can face serious legal consequences for false statements, including fines and up to five years imprisonment.

For his part, Fauci has maintained his innocence, even after receiving Biden’s pardon. During one contentious exchange with Paul, he declared, “If there is any lying here, senator, it is you,” while pointing his finger at the Kentucky lawmaker.

With the Justice Department under former Attorney General Pam Bondi or acting Attorney General Todd Blanche making no public statements about pursuing charges against Fauci, the window for formal prosecution appears to be closing, but the political and public health controversy shows no signs of abating.
