Muslim Leaders Challenge Texas Governor’s Terrorist Designation of CAIR

A coalition of Muslim and interfaith leaders is calling on Texas Governor Greg Abbott to rescind his proclamation that designates the Council on American-Islamic Relations (CAIR) as a “foreign terrorist organization” and “transnational criminal organization.”

At a news conference on Tuesday, representatives from various Muslim groups denounced the governor’s action as defamatory, destructive, and dangerous. The controversy has escalated with CAIR filing a lawsuit against the state of Texas, arguing that Abbott’s declaration violates both the U.S. Constitution and state law.

The designation carries significant limitations despite being state-level only. Unlike federal Foreign Terrorist Organization (FTO) listings, which can only be issued by the U.S. State Department and trigger federal terrorism penalties, Abbott’s proclamation prevents CAIR from purchasing land in Texas under a new state statute targeting “foreign adversaries.”

“The governor is attempting to punish the nation’s largest Muslim civil rights and advocacy organization simply because he disagrees with its protected First Amendment rights to criticize a foreign state that is conducting genocide,” said Mustaffa Carroll, executive director for CAIR Dallas Fort Worth. “This is not only contrary to the United States Constitution, but finds no support in any Texas law.”

CAIR’s lawsuit contends that the designation violates its First Amendment rights and due-process protections. The organization also argues that Texas has overstepped its authority since terrorism designations traditionally fall under federal, not state, jurisdiction.

Marium Uddin of the Muslim Legal Defense Fund challenged the governor’s characterization, saying, “You know that CAIR has condemned Hamas attacks. You know that CAIR has spent 31 years fighting terrorism and bigotry. You know that the terrorism boogeyman you invoke is nothing more than a tired, formulated playbook to stoke fear of Muslims.”

The controversy has drawn support for CAIR from across religious lines. Deborah Armintor from Jewish Voice for Peace expressed solidarity with CAIR, calling Abbott’s proclamation “false and unconstitutional.” Democratic State Representative Terry Meza added that the governor’s words “are not just wrong, they’re dangerous” to the Muslim community.

Abbott’s proclamation also extended the “terrorist” label to the Muslim Brotherhood, though neither CAIR nor the Muslim Brotherhood has ever been classified as terrorist organizations by the federal government.

The designation comes amid heightened tensions surrounding the Israel-Hamas conflict and growing concerns about Islamophobia in the United States. Civil rights advocates worry that such state-level actions could embolden discrimination against Muslim Americans and organizations advocating for their rights.

Legal experts note that the case raises important questions about the limits of state authority in national security matters. While states have traditionally deferred to federal agencies on terrorism designations, Abbott’s move represents an unusual assertion of state power in this domain.

The lawsuit is ongoing, and it remains unclear whether a court will uphold Abbott’s order or strike it down. The case could potentially set a significant precedent regarding state powers in designating organizations as terrorist entities.

For now, CAIR and its supporters are continuing to advocate against what they view as an unconstitutional overreach, while the governor’s office has not yet responded to the specific claims made during Tuesday’s press conference.
