Democrat Proves Decisive in Advancing Mullin’s Confirmation for DHS Secretary

In a surprising twist during a heated confirmation process, Sen. John Fetterman (D-Pa.) cast the crucial vote to advance Sen. Markwayne Mullin (R-Okla.) to the Senate floor for consideration as the next Secretary of Homeland Security.

The advancement came despite firm opposition from Sen. Rand Paul (R-Ky.), who chairs the Senate Homeland Security and Governmental Affairs Committee. Paul declared Mullin “unfit” for the role, creating an unusual scenario where a committee chairman opposed a nominee from his own party.

“I will not be supporting Senator Mullin’s nomination,” Paul stated during Thursday’s committee vote. Paul cited concerns about Mullin’s temperament, particularly referencing previous comments Mullin made about Paul’s 2017 assault, which Mullin had characterized as “justified.” Paul added that Mullin’s unwillingness to apologize for these remarks, combined with his confrontational behavior during a previous hearing with Teamsters President Sean O’Brien, demonstrated a lack of leadership qualities necessary for the position.

“We’re in the midst of a crisis where there needs to be more direction from the top,” Paul explained. “And a guy who brawls, a guy who can’t even say he’s sorry about wishing violence on me — I don’t know how he could be a leader of ICE or Border Patrol.”

Throughout the confirmation hearing, Mullin attempted to demonstrate his readiness for the role, pledging accountability and commitment. “I’m going to earn the job, I won’t fail you,” Mullin assured the committee. “I won’t back down from a challenge. And I’ll also admit when I’m wrong. I’m not perfect.”

The committee vote nearly didn’t happen after Paul and Sen. Gary Peters (D-Mich.), the committee’s ranking Democrat, clashed over undisclosed travel Mullin had undertaken years ago while serving in the House of Representatives. Both senators requested a classified briefing on the matter, though Paul ultimately didn’t attend the session. A spokesperson for Paul later said the senator had already decided his vote but wanted to ensure other committee members received the information they needed.

Fetterman’s support proved decisive in moving the nomination forward. As the only Democrat on the committee to back Mullin, Fetterman’s vote prevented what would have been a significant setback for Republicans trying to expedite the confirmation process.

“I came here and committed to come here with an open mind, and I’m going to continue to do that,” Fetterman explained after the hearing. “It’s not going to be about gotcha moments for me. My experience with you has been consistent and professional.”

The nomination now heads to the full Senate, where it will need only a simple majority to pass. However, Mullin may face additional challenges as several Senate Democrats have indicated opposition due to ongoing disputes over DHS operations, particularly regarding Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP).

Senate Minority Leader Chuck Schumer (D-N.Y.) has already announced his opposition. “I will not be supporting Senator Mullin’s nomination should it come before the Senate,” Schumer said. “The problems at DHS, especially at ICE and CBP, run far deeper than just who is in charge.”

Despite these obstacles, Senate Majority Leader John Thune (R-S.D.) expressed confidence in Mullin’s chances for confirmation. “Obviously, [Wednesday’s] hearing sounds like it got a little spicy at times,” Thune acknowledged. “But at the end of the day, it comes back to the job, and it comes back to the right person for the job. And I think that Markwayne is the right person.”

The confirmation process comes amid heightened tensions over border security and immigration policy, with DHS at the center of these contentious issues. If confirmed, Mullin would take leadership of one of the federal government’s largest departments during a period of significant political and operational challenges.
