Border Patrol Officials Praised Agent Who Shot Chicago Woman, Evidence Shows
Border Patrol commander Gregory Bovino commended a federal agent who shot a Chicago woman during an immigration enforcement operation last year, according to evidence released Wednesday that attorneys say demonstrates the Trump administration mishandled the investigation and spread falsehoods about the incident.
Marimar Martinez, a U.S. citizen working as a teaching assistant, was shot five times by Border Patrol agent Charles Exum while she sat in her vehicle last October. Following the shooting, Homeland Security officials charged Martinez with a felony, claiming she attempted to ram agents with her car. However, the case collapsed after video evidence emerged showing an agent actually steering his vehicle into Martinez’s car.
The evidence was made public after Martinez’s attorneys pushed for its release, citing concerns heightened by a similar incident in Minneapolis where federal agent fatally shot Renee Good. U.S. District Judge Georgia Alexakis lifted a protective order last week, rejecting government arguments that the documents might damage Exum’s reputation.
“This is a time where we just cannot trust the words of our federal officials,” attorney Christopher Parente stated at a news conference where his office presented the evidence.
The newly released documents reveal a troubling pattern of behavior by federal officials. In one email, Bovino, who led nationwide enforcement operations before recently returning to his previous post in California, wrote to Exum: “In light of your excellent service in Chicago, you have much yet left to do!!”
Other agents congratulated Exum in group texts, calling him a “legend” and offering to buy him beer. Previously released messages showed Exum apparently boasting about his marksmanship, writing: “I fired 5 rounds and she had 7 holes. Put that in your book boys.”
The evidence also includes what Parente described as a fabricated hand-drawn diagram purporting to show how Martinez “boxed in” federal agents. The attorney claimed the diagram included vehicles that “don’t exist.”
Martinez’s attorneys outlined multiple instances where DHS officials allegedly lied about Martinez following the shooting, including labeling her a “domestic terrorist” and falsely claiming she had a history of “doxxing federal agents.” The Montessori school assistant has no criminal record, and prosecutors presented no evidence supporting either accusation.
The shooting occurred during an intensified immigration enforcement crackdown in the Chicago area, where arrests, protests, and tense confrontations with immigration agents had become commonplace. Just weeks before Martinez was shot, agents had fatally shot a suburban Chicago father during a traffic stop.
Body camera footage from the day of Martinez’s shooting shows she had followed agents’ vehicles and honked her horn to alert others to the presence of immigration officials. The video captures agents rushing from their vehicle with weapons drawn, with one saying, “It’s time to get aggressive and get the (expletive) out.”
After the shooting, Martinez was hospitalized before being taken into FBI custody. Her car remains in FBI possession. While she has a valid concealed-carry license and had a handgun in her purse, her attorneys showed evidence that the weapon remained at the bottom of her purse in a pink holster throughout the encounter.
U.S. Customs and Border Protection said in a Wednesday statement that use-of-force incidents “are thoroughly investigated” and confirmed that Exum has been placed on administrative leave.
Martinez has largely avoided media interviews but has recently testified before congressional Democrats about excessive force by DHS officers, appearing alongside members of Renee Good’s family. She is scheduled to attend President Donald Trump’s upcoming State of the Union address as a guest of U.S. Rep. Jesus “Chuy” Garcia.
“They are not targeting the worst of the worst, they are targeting individuals who fit a certain profile, who simply have a certain accent, or a non-white skin color just like mine,” Martinez said in her congressional testimony. “This raises serious concerns about fairness, discrimination, and abuse of authority. The lack of accountability for these actions is deeply troubling.”
Martinez’s attorneys said they plan to pursue a complaint under the Federal Tort Claims Act. If the agency denies the claim or fails to act within six months, they can proceed with a federal lawsuit.
