Judge Expressed Concerns Over Former Lt. Gov. Fairfax’s Mental State Before Murder-Suicide

A Virginia judge had documented serious concerns about former Lt. Gov. Justin Fairfax’s mental health just weeks before the politician killed his wife and then himself in a shocking murder-suicide that has stunned the Virginia political community.

Court documents reveal that Fairfax County Circuit Court Judge Timothy J. McEvoy noted Fairfax’s “isolation, drinking and lack of participation in family life” in a March 30 court order involving custody arrangements for the couple’s two teenage children. The judge described these behaviors as “manifestations of what seems to be a sense of fatalism and hopelessness.”

The tragedy unfolded early Thursday morning when Fairfax shot his wife, Dr. Cerina Fairfax, before taking his own life. The couple had been living under the same roof during ongoing divorce proceedings, a situation the judge had characterized as creating “extremely high” tension “for an extended period of time.”

The murder-suicide occurred just days before an April 21 divorce hearing and an April 30 court-ordered deadline for Fairfax to vacate the family home in Annandale, Virginia, a suburb of Washington, D.C. Law enforcement officials confirmed Fairfax had recently been served with paperwork related to the upcoming court date.

Court documents paint a troubling picture of Fairfax’s deteriorating mental state. In 2022, he purchased a handgun using money reportedly intended for his children’s horseback riding lessons. During what was described as “a kind of adverse psychological event,” Fairfax left his home with the weapon, prompting relatives to conduct a frantic search before finding him in a nearby public park.

According to the court record, Fairfax’s brother eventually called a mental health professional after being “unable to calm him down over the course of several hours.” Despite these red flags, Judge McEvoy did not order psychological therapy, though he noted there was no evidence Fairfax had sought professional help on his own.

The New York Post reported that Fairfax’s drinking had become severe enough that he regularly locked himself in his home office, surrounded by “empty wine bottles, trash and piles of dirty laundry,” only emerging “long enough to get food or smoke cigarettes.”

Fairfax served as Virginia’s lieutenant governor from 2018 to 2022. What had once been a promising political career took a dramatic downturn in 2019 when two women accused him of sexual assault during his time as a student at Duke University. Court documents acknowledge the profound impact these allegations had on Fairfax, stating that they “deeply affected [him] and appear to have put an end to” his gubernatorial ambitions.

“At that time, [Fairfax] was the Lieutenant Governor of Virginia and was an ascendant political figure who was eyeing a run for Governor,” the court documents stated, noting how the sexual assault allegations had derailed his political trajectory.

The couple’s marital troubles intensified in the aftermath of these allegations, eventually leading to divorce proceedings. Investigators believe the contentious divorce was likely a significant factor in Fairfax’s decision to commit the murder-suicide.

The shocking deaths have sent ripples through Virginia’s political community, where Fairfax had once been considered a rising star in Democratic politics before the sexual assault allegations emerged. The tragedy also highlights the sometimes hidden mental health struggles that can accompany public downfalls and personal crises.

As authorities continue their investigation, the case raises important questions about how mental health concerns are addressed in family court proceedings and what warning signs might have been missed in the weeks leading up to the violence.
