U.S. Rep. Cherfilus-McCormick Released on $60,000 Bond in Federal Fraud Case

A federal judge in Miami set a $60,000 bond Tuesday for U.S. Rep. Sheila Cherfilus-McCormick, who made her first court appearance to face serious allegations of misappropriating federal pandemic relief funds. The Florida Democrat is facing 15 federal counts related to the alleged theft of $5 million meant for COVID-19 vaccination efforts.

During the hearing, Cherfilus-McCormick stood alongside her attorneys as Judge Enjoliqué Lett read all 15 charges. The congresswoman confirmed her understanding of the accusations against her, according to the South Florida SunSentinel.

The charges stem from allegations that Cherfilus-McCormick’s family health care business, Trinity Healthcare Services, kept millions in overpaid federal funds intended to register people for COVID-19 vaccinations in 2021. Prosecutors claim the company requested $50,000 but mistakenly received $5 million and failed to return the excess funds.

“Today I made my initial appearance in a case that is both politically timed and politically motivated,” Cherfilus-McCormick said in a statement sent to the Associated Press. “Let me be clear: I am innocent and I look forward to my day in court. This has been a fight not just for my name — it’s a fight for my constituents, an attack on the progress we have been making and the movement we have started.”

The indictment, unsealed earlier this month, contains particularly damaging allegations about how the funds were used. Prosecutors claim that within two months of receiving the money, over $100,000 was spent on a 3-carat yellow diamond ring for the congresswoman. The government also alleges that portions of the money were distributed to friends and relatives who subsequently made donations to Cherfilus-McCormick’s congressional campaign.

Judge Lett imposed several restrictions as conditions of the bond. Cherfilus-McCormick must surrender her personal passport, though she will be permitted to retain her congressional passport to perform her official duties. Her travel is restricted to Florida, Washington D.C., Maryland, and the Eastern District of Virginia.

The case has significant political implications for Florida’s 20th Congressional District, which encompasses parts of Broward and Palm Beach counties. Cherfilus-McCormick won her seat in a January 2022 special election following the death of longtime Rep. Alcee Hastings in 2021. She has since established herself as a key Democratic voice in the Florida delegation.

Through her attorney, David Oscar Markus, the congresswoman has consistently denied all charges. According to a statement provided by her chief of staff, she has no plans to resign from office and maintains she has cooperated with “every lawful request” related to the investigation.

The charges Cherfilus-McCormick faces are extensive and serious, including theft of government funds, making and receiving straw donor contributions, aiding and assisting false tax return statements, money laundering, and conspiracy charges associated with each of those counts. If convicted, she could face substantial fines and prison time.

The case highlights ongoing concerns about the oversight of pandemic relief funds, which were distributed quickly and in unprecedented amounts during the height of the COVID-19 crisis. The Department of Justice has prioritized investigating fraud related to these programs, with numerous cases being brought against individuals and businesses accused of misusing emergency funds.

As the legal process unfolds, Cherfilus-McCormick vows to continue serving her constituents while fighting the charges. “I will not be intimidated or silenced,” she stated, framing the case as a politically motivated attack on her work in Congress.

The congresswoman’s next court appearance has not yet been announced, but the case is expected to draw significant attention as it proceeds through the federal court system.
