Former special counsel Jack Smith firmly rejected accusations that politics influenced his investigations into former President Donald Trump during a closed-door deposition before the House Judiciary Committee on Wednesday.

In his opening statement, Smith took full responsibility for the criminal cases he brought against Trump regarding the 2020 election and alleged retention of classified documents, emphasizing that the charges stemmed from Trump’s own actions rather than political motivations.

“The decision to bring charges against President Trump was mine, but the basis for those charges rests entirely with President Trump and his actions, as alleged in the indictments returned by grand juries in two different districts,” Smith told lawmakers, according to portions of his statement obtained by Fox News Digital.

Smith further defended the integrity of his investigations, stating he would have pursued identical prosecutions regardless of political affiliation. “If asked whether to prosecute a former President based on the same facts today, I would do so regardless of whether the President was a Republican or Democrat,” he said.

The high-profile deposition marks a significant moment in the ongoing political and legal battles surrounding the former president. Republican lawmakers have frequently criticized Smith for what they perceive as politically motivated prosecutions designed to hinder Trump’s 2024 presidential campaign.

Republican committee members were expected to press Smith on several controversial aspects of his investigations, including his requests for gag orders against Trump during the presidential campaign, efforts to expedite court proceedings, and the subpoenaing of phone records from some Republican members of Congress.

These issues have become flashpoints in the broader debate about the Justice Department’s handling of cases involving high-profile political figures. Critics have questioned whether Smith’s prosecutorial decisions were influenced by political considerations rather than legal merit.

The special counsel’s work resulted in two major indictments against Trump. The first concerned Trump’s alleged mishandling of classified documents after leaving office, with prosecutors claiming he improperly retained sensitive national security materials at his Mar-a-Lago estate. The second indictment focused on Trump’s efforts to overturn the 2020 election results, including actions leading up to the January 6, 2021, Capitol riot.

Both cases have been effectively halted since Trump won the 2024 presidential election. As president-elect, Trump is expected to direct his incoming Justice Department to dismiss the federal charges once he takes office in January.

Smith’s appearance before the committee occurs during the congressional transition period, with Republicans preparing to hand control of the House to Democrats following November’s election results. This timing adds another layer of political complexity to the proceedings.

As the closed-door session began, Rep. Jared Moskowitz, D-Fla., briefly emerged to tell reporters the deposition was “boring” in its early stages, suggesting the questioning had not yet reached the more contentious topics expected to dominate the session.

The deposition could potentially stretch for hours as committee members from both parties question Smith about his decision-making process, investigative methods, and response to criticism that his prosecutions were politically timed to impact Trump’s campaign.

Smith’s testimony comes amid broader discussions about the role of special counsels in politically sensitive investigations and the challenges of maintaining independence and public trust when investigating current or former presidents.

The committee has not yet announced when or if a transcript of the full deposition will be released to the public.
