House Freedom Caucus Backs Effort to Impeach Judge Boasberg Over Trump Investigation Role

Members of the House Freedom Caucus are rallying behind Rep. Brandon Gill’s push to impeach U.S. District Judge James Boasberg, citing concerns about judicial overreach and political bias in the investigation of former President Donald Trump.

Gill, a Texas Republican, introduced an impeachment resolution against Boasberg last month, focusing on the judge’s role in “Arctic Frost” – the code name for former special counsel Jack Smith’s investigation into Trump and matters related to the 2020 election. According to Gill, Boasberg demonstrated partisan behavior when approving subpoenas and gag orders connected to the investigation.

Of particular concern to Republicans were subpoenas for phone records belonging to several GOP lawmakers, information that became public through documents released by Senate Judiciary Committee Chairman Chuck Grassley earlier this year.

“It absolutely should be done,” House Freedom Caucus Chairman Andy Harris told Fox News Digital. “I think this is levels above what we thought was going on. His bias is pretty clear, someone with that kind of bias cannot exist in the federal judiciary.”

However, despite expressing strong support for impeaching Boasberg, Harris indicated that the conservative group would not pressure House Speaker Mike Johnson on the issue in the immediate future, noting that the caucus is currently focused on fiscal matters.

Other Freedom Caucus members have voiced similar support. Policy Chairman Chip Roy pointed to “massive concerns” about the judge “making up facts out of thin air and assumptions based on motives that have no basis.” Rep. Ralph Norman of South Carolina, who is also running for governor, labeled Boasberg as “one of the rogue judges that exist today,” adding that “there are consequences for what he did.”

Rep. Eli Crane of Arizona, an early advocate for impeaching judges perceived as issuing partisan rulings during the Trump era, expressed support but remained cautious about the prospects of success. “I don’t tend to have confidence in anything around here until I see action taken. Talk is cheap,” Crane remarked.

This isn’t the first time Boasberg has faced impeachment efforts. Several House Freedom Caucus members, including Gill, introduced similar resolutions last spring after Boasberg temporarily blocked Trump’s deportation flights to El Salvador.

At that time, Speaker Johnson cautioned Republicans that impeachment might not be the most effective approach to address “rogue judges,” noting that removal would require Senate support that wasn’t available. Instead, House GOP leadership supported legislation by Rep. Darrell Issa aimed at limiting district court judges’ power to issue nationwide injunctions. Though the bill passed the House in April, it stalled in the Senate.

Issa, who chairs the House Judiciary panel’s subcommittee on courts, continues to advocate for a measured approach. “We have a number of rogue judges, and I think before we talk about impeachment, with so many people seeing wrongdoing, both the House and the Senate need to hold appropriate hearings,” he said. Issa indicated he was considering hearings on the matter when lawmakers return from Thanksgiving recess.

The current impeachment effort highlights ongoing tensions between congressional Republicans and the federal judiciary over cases involving the former president. While the Freedom Caucus appears united in their criticism of Boasberg, the path forward remains unclear, particularly without broader support from House leadership and the practical challenges of securing the necessary votes in the Senate.
