Democratic Representative Teresa Leger Fernandez of New Mexico formally introduced an expulsion resolution against Republican Representative Tony Gonzales of Texas on Tuesday, after he missed her deadline to resign from Congress amid ongoing controversy.

Gonzales had announced his intention to “file his retirement” on Monday but failed to provide a specific timeline for his departure. The ultimatum from Leger Fernandez required Gonzales to resign by Tuesday at 2 p.m. Eastern time, a deadline that passed without the formal resignation she demanded.

The Texas congressman has been embroiled in scandal since admitting to an extramarital affair with a former staff member earlier this year. Gonzales had previously denied these allegations multiple times before finally acknowledging the relationship, triggering ethics concerns and calls for his resignation from colleagues on both sides of the aisle.
