After more than a year of legal maneuvering, Fulton County District Attorney Fani Willis is scheduled to appear Wednesday before a Georgia state Senate committee investigating her handling of the high-profile prosecution against former President Donald Trump.

The Democratic prosecutor’s testimony before the Republican-dominated Special Committee on Investigation marks a significant development in the political and legal saga that has unfolded since Willis announced charges against Trump and 18 co-defendants in August 2023.

Whether Willis will provide substantive answers remains uncertain. Her attorney, former Democratic Georgia Governor Roy Barnes, indicated during a state Supreme Court hearing last week that Willis may limit her responses to the committee’s questions.

“You can’t just pick somebody out and say, ‘We’re going to embarrass you; we’re going to try you; we’re going to harass you,'” Barnes told justices. “So we’ll make an appropriate objection at the time. I’m not a potted plant.”

The committee, created in January 2024, was established to investigate allegations of misconduct by Willis related to her prosecution of efforts to overturn Trump’s 2020 election loss in Georgia. Willis had employed Georgia’s anti-racketeering law to allege a conspiracy to illegally overturn Trump’s narrow defeat to Democrat Joe Biden in the state.

While Republican lawmakers expressed disapproval of the prosecution from the outset, the committee has primarily focused on Willis’ hiring of special prosecutor Nathan Wade and their subsequent romantic relationship, which the committee’s founding resolution described as a “clear conflict of interest and a fraud upon the taxpayers.”

The case against Trump ultimately collapsed after Willis was removed from the prosecution and another prosecutor dismissed the charges. Trump has since called Willis a “criminal” who should be “prosecuted” and “put in jail,” potentially increasing her caution in testimony.

Democratic lawmakers have criticized the committee as a politically motivated exercise. Four Republican committee members are running for statewide office in 2026, including Chairman Bill Cowsert of Athens, who is seeking the attorney general position, and Sens. Greg Dolezal of Cumming, Blake Tillery of Vidalia, and Steve Gooch of Dahlonega, all pursuing the Republican nomination for lieutenant governor. A fifth Republican member, John Kennedy of Macon, resigned from the Senate last week to launch his own lieutenant governor campaign.

Willis previously declined to appear before the committee when initially subpoenaed last year, leading to legal proceedings regarding the committee’s authority. A judge ruled Willis could not ignore the subpoena, prompting her legal team to negotiate an appearance agreement when the subpoena was reissued this year.

The Trump prosecution began unraveling in January 2024 when defense attorneys alleged Willis was involved in an improper relationship with Wade. During subsequent hearings, both Willis and Wade testified about their relationship while denying it constituted a conflict of interest.

Though the trial judge criticized Willis for a “tremendous lapse in judgment,” he initially allowed her to remain on the case provided Wade resigned, which he promptly did. However, defense attorneys appealed the decision, and the Georgia Court of Appeals cited an “appearance of impropriety” in removing Willis from the case entirely. The Georgia Supreme Court declined to hear Willis’ appeal in September, effectively ending her involvement in the prosecution.

To date, the committee has uncovered limited new information about Willis’ conduct. With the case now dismissed and political tensions heightened, Wednesday’s hearing represents a culmination of the prolonged power struggle between the Democratic prosecutor and Republican state lawmakers over one of the most politically charged criminal cases in Georgia’s recent history.
