Florida Officials Take Initial Steps to Advance Recreational Marijuana Initiative

Florida election officials have begun processing a proposed ballot initiative to legalize recreational marijuana, following pressure from activists who claimed state officials were attempting to block the measure.

The development came after Smart & Safe Florida, the campaign behind the initiative, filed a complaint with the Florida Supreme Court. The group alleged that officials in Governor Ron DeSantis’ administration were improperly attempting to prevent the measure from appearing on the 2026 ballot.

In a November 17 legal filing, Florida Secretary of State Cord Byrd argued the lawsuit should be dismissed as moot. State officials have now issued a formal letter to Smart & Safe Florida and submitted the proposed amendment to Florida’s attorney general, confirming the campaign has gathered the hundreds of thousands of voter signatures required to qualify for ballot consideration.

These procedural steps trigger the process for the state Supreme Court to review the proposed amendment language, a requirement under Florida law before any initiative can advance to the ballot.

The dispute highlights the ongoing tension between progressive organizers seeking constitutional amendments and Florida’s conservative leadership. Governor DeSantis, a Republican, used state resources and his political influence earlier this year to successfully campaign against similar ballot initiatives that would have legalized adult marijuana use and expanded abortion rights.
