U.S. Congresswoman Maintains Innocence in $5 Million COVID Funds Case
U.S. Rep. Sheila Cherfilus-McCormick forcefully declared her innocence Monday outside a Miami federal courthouse where she faces serious accusations of misappropriating millions in pandemic relief funds.
“I just want to make it very clear that I am innocent,” Cherfilus-McCormick told reporters after a brief court appearance. “In no way did I steal any kind of funds. I’m committed to the people of Florida and my district.”
The Florida Democrat, who was scheduled for arraignment, had her proceeding postponed until January 20 at her attorney’s request to finalize her legal representation. The hearing lasted less than five minutes, with prosecutors offering no objection to the delay.
Cherfilus-McCormick faces 15 federal counts related to allegations she conspired to steal $5 million in federal COVID-19 disaster funds that were mistakenly overpaid to her family’s business, Trinity Healthcare Services. According to prosecutors, the company had contracted to register people for COVID-19 vaccinations but received substantially more money than requested.
The indictment alleges that within two months of receiving the funds in 2021, over $100,000 was spent on a 3-carat yellow diamond ring for the congresswoman. Federal investigators claim that while Trinity Healthcare requested $50,000, they received $5 million through a clerical error and failed to return the excess funds.
Prosecutors further allege that the money was distributed to various accounts, including to friends and relatives who subsequently made donations to Cherfilus-McCormick’s congressional campaign, effectively constituting illegal straw donations.
Her attorney, David Oscar Markus, has characterized the case as involving administrative errors that “generally aren’t even misdemeanors, let alone felonies.” He suggested the prosecution may be politically motivated, though he did not elaborate on those claims during Monday’s brief court appearance.
Cherfilus-McCormick was arrested in November and released on a $60,000 bond. The court has imposed travel restrictions, allowing her to move only between Florida, Washington, D.C., Maryland, and the Eastern District of Virginia. While required to surrender her personal passport, she has been permitted to retain her congressional passport to perform her official duties.
The charges against her include theft of government funds, making and receiving straw donor contributions, aiding and assisting a false and fraudulent statement on a tax return, money laundering, and related conspiracy charges. Despite the serious allegations, Cherfilus-McCormick has indicated through her chief of staff that she does not plan to resign from office.
Cherfilus-McCormick’s legal troubles come less than three years into her congressional career. She won a special election in January 2022 to represent Florida’s 20th Congressional District, which includes portions of Broward and Palm Beach counties, following the death of longtime Representative Alcee Hastings in 2021.
The case highlights ongoing scrutiny of COVID-19 relief fund misuse nationwide. Since the pandemic began, federal prosecutors have pursued hundreds of cases involving fraud related to pandemic assistance programs, with alleged schemes ranging from small business loan fraud to unemployment benefits theft.
According to her staff, Cherfilus-McCormick has cooperated with “every lawful request” and will continue to do so until the matter is resolved. The congresswoman’s case draws additional attention as one of the few sitting members of Congress to face federal criminal charges while in office.
If convicted, Cherfilus-McCormick could face significant prison time and fines, though sentencing would depend on various factors including federal guidelines and judicial discretion.
