The FBI has taken control of an investigation into a fatal shooting by an Immigration and Customs Enforcement agent in Minnesota, creating a jurisdictional dispute with state authorities who insist they will conduct their own parallel inquiry.

The controversy erupted after the Minnesota Bureau of Criminal Apprehension (BCA) revealed it had been excluded from the investigation into the death of 37-year-old Renee Good, who was shot and killed by an ICE agent as she accelerated her vehicle toward him. The incident was captured on video.

Department of Homeland Security Secretary Kristi Noem defended the federal government’s position on Thursday, stating that Minnesota authorities “have not been cut out; they don’t have any jurisdiction in this investigation.” Noem characterized the incident as an attack on a federal agent, saying, “The officer feels as though his life was in jeopardy. [The vehicle] was used to perpetuate a violent act. This officer took action to protect himself and to protect other law enforcement officers.”

Minnesota Democratic Governor Tim Walz criticized Noem’s characterization, suggesting it predetermined the outcome of what should be an objective investigation. While many Democrats have condemned the shooting as murder and an inappropriate use of lethal force, the Trump administration has taken a different stance.

A federal law enforcement source told Fox News Digital that this case clearly falls under federal jurisdiction. The source referenced a recent letter from Deputy Attorney General Todd Blanche to California officials that established that federal officers acting in their official capacity are protected from state charges.

“The Department of Justice views any arrests of federal agents and officers in the performance of their official duties as both illegal and futile,” Blanche wrote. “Numerous federal laws prohibit interfering with and impeding immigration or other law-enforcement operations… Further, the Supremacy Clause of Article VI of the United States Constitution precludes a federal officer from being held on a state criminal charge where the alleged crime arose during the performance of his federal duties.”

While federal officers are generally protected by the Supremacy Clause when performing their duties, they do not enjoy complete immunity from state prosecution—a long-standing point of legal contention.

In a press conference on Friday, Hennepin County Attorney Mary Moriarty disputed the federal government’s jurisdictional claims, asserting, “We do have jurisdiction to make the decision with what happened in this case. It does not matter that it was a federal law enforcement agent.” She acknowledged, however, that cases involving federal officers involve “complex legal issues.”

Minnesota Attorney General Keith Ellison, appearing alongside Moriarty, expressed skepticism about the FBI’s ability to conduct an impartial investigation. The state officials called on the public to provide any evidence or tips directly to state prosecutors, claiming that the FBI had prevented them from reviewing evidence in the case.

“To the degree that it’s possible, [we want] to set forth a process which, when it’s over, fair-minded people can say, ‘Well as good and just of a job that could be done was done,'” Ellison stated.

Deputy Attorney General Blanche responded on Thursday that “following any officer-involved shooting, standard protocols ensure that evidence is collected and preserved,” suggesting proper procedures were being followed.

Multiple sources told Fox News Digital that federal officials doubted Minnesota’s ability to conduct an unbiased investigation, citing statements from local leaders including Democratic Minneapolis Mayor Jacob Frey, who dismissed claims of the ICE agent acting in self-defense as “bull—-.”
