While federal officers are generally protected by the Supremacy Clause when performing their duties, they do not enjoy complete immunity from state prosecution—a long-standing point of legal contention.
In a press conference on Friday, Hennepin County Attorney Mary Moriarty disputed the federal government’s jurisdictional claims, asserting, “We do have jurisdiction to make the decision with what happened in this case. It does not matter that it was a federal law enforcement agent.” She acknowledged, however, that cases involving federal officers involve “complex legal issues.”
Minnesota Attorney General Keith Ellison, appearing alongside Moriarty, expressed skepticism about the FBI’s ability to conduct an impartial investigation.
