Federal authorities have blocked Minnesota officials from investigating a fatal shooting by an immigration officer in Minneapolis, escalating tensions between state and federal jurisdictions.

The dispute erupted Thursday when the FBI denied Minnesota law enforcement access to evidence in the Wednesday shooting that killed 37-year-old Renee Good. Homeland Security Secretary Kristi Noem confirmed that federal officials had rescinded a cooperation agreement with the Minnesota Bureau of Criminal Apprehension, stating bluntly: “They don’t have any jurisdiction in this investigation.”

The case highlights growing tensions over federal immigration enforcement operations in local communities and raises questions about accountability when federal agents use deadly force. Legal experts note the conflict centers on whether a federal officer performing official duties can be investigated or charged under state law.

Minnesota Governor Tim Walz criticized the federal response, warning that early statements defending the agent risk undermining public confidence in the investigation. “If the FBI is the sole investigative agency, the state will not receive the investigative findings, and our community may never learn about its contents,” said Hennepin County Attorney Mary Moriarty in a statement.

Federal officers typically claim immunity from state prosecution under the Constitution’s Supremacy Clause, which protects federal employees performing federally authorized duties. However, this immunity isn’t absolute, according to Robert Yablon, professor at the University of Wisconsin Law School.

“The legal standard basically is that a federal officer is immune from state prosecution if their actions were authorized by federal law and necessary and proper to fulfilling their duties,” Yablon explained. For state prosecutors to overcome immunity claims, they must demonstrate both a violation of state law and that the force used was unconstitutionally excessive under federal standards.

Deputy Attorney General Todd Blanche defended federal agents’ use of force, noting that officers often face split-second decisions in dangerous situations. He asserted that the law doesn’t require officers “to gamble with their lives in the face of a serious threat of harm.”

The jurisdictional dispute significantly complicates any potential investigation. Minnesota Attorney General Keith Ellison indicated during a CNN interview that state officials might pursue their own parallel investigation despite federal resistance. Hennepin County officials are “exploring all options” to ensure a state-level investigation continues.

The lack of cooperation means state investigators may be denied access to critical evidence, including training records, protocols, and interviews with federal agents present during the incident. In previous high-profile use-of-force cases, such as the Derek Chauvin trial for George Floyd’s death, evidence about departmental training protocols played a crucial role.

Samantha Trepel, Rule of Law program director at States United Democracy Center and former Justice Department civil rights prosecutor, expressed concerns about the current situation. “In previous administrations, DOJ conducted independent and thorough investigations of alleged federal officers’ excessive force. Even though the feds were investigating feds, they had a track record of doing this work credibly,” Trepel noted.

Questions have also emerged about the medical response following the shooting. Witness videos show a man identifying himself as a physician attempting to provide aid to Good but being turned away by agents. The footage later shows emergency medical personnel unable to reach the scene in their vehicle, with bystanders ultimately carrying Good away.

The controversy comes amid heightened scrutiny of federal immigration enforcement tactics under the current administration. Critics argue that federal officials can conduct immigration enforcement effectively without resorting to what Trepel characterized as “brutal tactics and chaos.”

As tensions between state and federal authorities continue, Minnesota officials remain determined to assert their investigative role while federal agencies maintain exclusive jurisdiction over the case. The outcome of this jurisdictional standoff could set important precedents for accountability in cases involving federal officers operating in local communities.
