The Department of Homeland Security has criticized media outlets for describing the suspect in a recent Wisconsin machete attack as a “Green Bay man” rather than identifying him as an undocumented immigrant from Nicaragua.
David Joel Herrera-Garcia, 24, faces multiple serious charges including two counts of attempted murder, aggravated assault, and armed burglary following an alleged break-in and violent attack at his ex-girlfriend’s home. According to DHS officials, Herrera-Garcia had been classified as a “non-enforcement priority” under Biden administration immigration policies.
The brutal incident occurred in the early morning of April 20, when Green Bay police responded to an emergency call and discovered two bloodied victims. According to DHS reports, officers found blood “all over the concrete” leading to the residence. The female victim, identified as Herrera-Garcia’s 23-year-old ex-girlfriend, immediately named him as her attacker. He was apprehended later that same morning.
Law enforcement reports indicate Herrera-Garcia allegedly used a key to enter his ex-girlfriend’s residence before attacking her and a male occupant with a machete. The female victim suffered a head injury along with lacerations to her hand and neck, while the male victim sustained wounds to his shoulder, forearm, and shin. First responders applied tourniquets at the scene before both victims were transported to a hospital.
DHS has now lodged an immigration detainer with the Brown County Jail, requesting that Herrera-Garcia be turned over to Immigration and Customs Enforcement (ICE) for potential deportation proceedings following any criminal case resolution.
“Yet again, legacy media has gone to bat for a vicious criminal illegal alien allowed by the Biden administration to roam our streets and prey upon innocent people,” said Acting Assistant Secretary Lauren Bis in a statement.
According to DHS information, Herrera-Garcia entered the United States illegally through Texas in 2019 as a minor accompanied by his father. He subsequently received a final order of removal in 2022 after failing to appear at scheduled immigration hearings. However, DHS officials stated that ICE, exercising prosecutorial discretion during the final period of the Biden administration, designated Herrera-Garcia as a “non-enforcement priority.”
This designation reportedly came after a prior encounter with local law enforcement when Herrera-Garcia was arrested for driving without a license. According to DHS, the Biden-era ICE opted not to take him into custody at that time.
“This is not a ‘Green Bay man.’ This is a criminal illegal alien from Nicaragua who barbarically attacked two people with a machete,” Bis stated. “Under President Trump’s leadership, ICE lodged an arrest detainer with our local authorities to ensure this monster is never released back into our communities.”
The case emerges amid ongoing national debate about immigration enforcement priorities and sanctuary policies across various jurisdictions. Critics of sanctuary policies argue they hamper cooperation between local law enforcement and federal immigration authorities, potentially allowing individuals with removal orders to remain in communities.
Bis has previously criticized sanctuary policies, stating that sanctuary politicians “have tried to slow ICE down and chosen to release criminals from their jails into our communities to perpetrate more crimes and create more victims.”
The incident highlights the complex intersection of local criminal justice systems and federal immigration enforcement, particularly regarding individuals who have received removal orders but remain in the United States. It also underscores tensions between differing approaches to immigration enforcement priorities under successive presidential administrations.
The Brown County Sheriff’s Office has not yet issued a public response regarding the detainer request or potential transfer to ICE custody. Representatives for former President Biden have also not commented on the specific case or the DHS criticism of his administration’s immigration enforcement priorities.
