The Department of Homeland Security has publicly criticized Santa Clara County for failing to honor Immigration and Customs Enforcement (ICE) detainer requests for two Honduran nationals accused of murdering a 24-year-old mother in early January.
Franquin Inestroza-Martinez and Gerzon Jose Chirinos-Munguia were arrested in connection with the shooting death of Kembery Chirinos-Flores, who was reportedly killed with a shotgun. Chirinos-Munguia, the father of the victim’s 5-year-old son, had previous encounters with law enforcement that did not lead to deportation proceedings.
According to DHS officials, Chirinos-Munguia was arrested in 2018 for battery and false imprisonment, and again in 2019 for domestic battery and making criminal threats. Following both arrests, he was released back into the community without ICE notification, a practice consistent with California’s sanctuary policies.
“A man lost his life, and a child is now without a mother. These illegal aliens should have never been able to commit these horrific killings and must NEVER be released from jail into American communities,” DHS Acting Assistant Secretary Lauren Bis said in a statement.
The case has highlighted ongoing tensions between federal immigration authorities and California’s sanctuary laws, particularly the California Values Act (CVA). Passed in 2017 during the Trump administration, the law prohibits local police from questioning individuals about their immigration status and limits cooperation between local authorities and federal immigration agents.
Inestroza-Martinez’s criminal history appears even more extensive. DHS officials report that he had been previously deported from the United States twice – once in 2013 and again in 2018. He allegedly reentered the country illegally before his involvement in the murder of Chirinos-Flores. “Instead of cooperating with ICE, Santa Clara sanctuary politicians REFUSED to honor ICE’s arrest detainer and will not notify ICE when these murderers are released from jail,” Bis added. “This insanity of refusing to turn cold-blooded killers over to ICE must end.”
The Trump administration previously sued California over the Values Act, arguing that it obstructed federal immigration enforcement. The legal challenge was dismissed by the U.S. District Court for the Eastern District of California, a decision that was upheld on appeal. The Supreme Court declined to hear the case in 2020, effectively leaving the sanctuary policies intact.
