An undocumented immigrant who was ordered deported in 2019 has been arrested following a fatal accident that claimed the life of an 8-year-old girl in Boise, Idaho. The incident has reignited debates about sanctuary state policies and driver’s license issuance to immigrants without legal status.
Elvin Elgardo Ramos-Caballero was driving a pickup truck on November 11 when he attempted to make a right-hand turn at a Boise intersection. While making the turn, he struck and killed 8-year-old Mora Gerety who was crossing the street, according to local authorities.
At the time of the accident, Ramos-Caballero had an outstanding federal warrant with Immigration and Customs Enforcement (ICE) for failing to appear at an immigration hearing. A judge had ordered his removal from the United States in May 2019. Despite this deportation order, he was legally driving with a license issued by the state of Oregon, which maintains sanctuary policies limiting cooperation with federal immigration authorities.
“Eight-year-old Mora Gerety’s precious life was taken by an illegal alien who should have never been in our country, let alone issued a driver’s license by the sanctuary state of Oregon,” said Department of Homeland Security Assistant Secretary Tricia McLaughlin in a statement following the incident.

Donalds has sponsored legislation called the WEIGH Act, which would grant the Department of Transportation broader authority to hold states accountable for CDL issuance practices and allow the Treasury Department to withhold federal funds from states that don’t comply with federal standards.
“You have the American people, they’re doing the right thing, and now they’re subject to losing their lives or being in an auto accident with a CDL driver who cannot read our signs, who doesn’t know our laws,” Donalds said in a recent interview.
The concerns follow a joint operation between ICE and Oklahoma Highway Patrol that recently resulted in the arrest of 70 undocumented immigrants, including 34 who were allegedly driving commercial trucks while in the country unlawfully.
