Conservative Group Launches Probe into Virginia Redistricting Vote as Legal Battle Intensifies

A conservative policy organization has initiated an investigation into Virginia’s contested redistricting amendment vote, following a court decision that blocked certification of the election results. The America First Policy Institute (AFPI) has announced a multi-faceted probe focusing on mail-in ballot procedures and allegations of political influence in classrooms.

The investigation comes amid escalating legal challenges surrounding the redistricting referendum, with the Virginia Supreme Court scheduled to hear oral arguments on Monday in what has become a high-stakes political and constitutional battle.

“The questions we’re asking aren’t complicated,” said Leigh Ann O’Neil, AFPI’s chief legal affairs officer. “Was the election conducted according to state and federal law? Did teachers improperly turn students into a private grassroots army? And, if so, what will the school district do about it?”

The first phase of AFPI’s investigation involves submitting records requests to several Virginia counties seeking detailed information about mail-in and absentee ballot handling. The requests specifically target how applications were processed, how ballots were distributed and accepted, storage procedures, and what guidance election officials followed during the referendum.

According to the organization, these materials constitute public records that should be available under Virginia law and could clarify whether proper electoral procedures were observed throughout the process.

A second component of the investigation centers on Fairfax County Public Schools, where AFPI is seeking records related to civics class materials and instruction. The group claims some parents have alleged that teachers commented on parents’ political beliefs and encouraged students to persuade their families how to vote on the referendum.

AFPI argues that such conduct, if confirmed, could violate state law, federal law, and school district policies governing political activity in publicly funded classrooms. The organization has also sent a letter to the Fairfax County superintendent urging an internal investigation into what it describes as “highly concerning reports of partisan voter influence.”

The redistricting controversy has spawned three separate legal challenges currently pending in Virginia courts. The primary lawsuit, brought by state Republicans, will be heard by the Virginia Supreme Court on Monday. Additionally, GOP Representatives John McGuire and Rob Wittman have filed a separate case in Richmond, while another challenge in Tazewell County resulted in Circuit Court Judge Jack Hurley ruling the referendum unconstitutional.

Virginia Democratic Attorney General Jay Jones is expected to appeal the Tazewell County ruling. Legal experts anticipate the Virginia Supreme Court could issue a ruling within weeks, as courts face mounting pressure to resolve the matter before Virginia’s August primary and late-July deadlines for voter registration and mail-in ballots.

The contentious redistricting process has significant implications for Virginia’s congressional map and potentially for control of the U.S. House of Representatives in future elections. Democrats have championed the redistricting effort as necessary reform, while Republicans have characterized it as a partisan power grab.

AFPI maintains its investigation aims to ensure transparency as the legal process unfolds. The organization contends that if election procedures were properly followed, the requested records will confirm it—and if not, Virginia voters deserve to know.

The Virginia Department of Elections and Fairfax County Public Schools have not yet responded to requests for comment on the investigation.

The Virginia Supreme Court hearing will be livestreamed, allowing the public to follow arguments in real time. Meanwhile, AFPI officials indicated their probe will continue in phases, with additional findings and records requests expected in the coming weeks as the legal battle over Virginia’s electoral maps continues to unfold.
