A Miami grand jury has indicted Florida Democratic Representative Sheila Cherfilus-McCormick on charges of allegedly misappropriating $5 million in federal disaster relief funds, the Department of Justice announced Wednesday.

According to prosecutors, Cherfilus-McCormick allegedly conspired with her brother Edwin Cherfilus and several co-defendants to divert Federal Emergency Management Agency (FEMA) funds for personal gain and illegal campaign contributions during her 2021 congressional bid.

The indictment details how the defendants reportedly routed the money through multiple accounts to conceal its source. Prosecutors allege that a significant portion of these misappropriated funds were channeled into Cherfilus-McCormick’s campaign or used for personal expenses.

“Using disaster relief funds for self-enrichment is a particularly selfish, cynical crime,” said Attorney General Pam Bondi in a statement. “No one is above the law, least of all powerful people who rob taxpayers for personal gain. We will follow the facts in this case and deliver justice.”

If convicted on all charges, the Florida Democrat could face up to 53 years in prison.

The case centers around a FEMA-funded COVID-19 vaccination staffing contract awarded in 2021 to the congresswoman’s family healthcare company, where both she and her brother worked. The indictment alleges that in July 2021, the company received an overpayment of $5 million in FEMA funds, which was then allegedly misused.

FBI Director Kash Patel commented on social media that Cherfilus-McCormick and her family “allegedly stole money from FEMA and then laundered it through friends toward her own personal benefits – including her campaign accounts.”

The indictment further claims that Cherfilus-McCormick and co-defendant Nadege Leblanc allegedly set up a network of straw donors to funnel the FEMA funds into campaign contributions, violating federal campaign finance laws.

The allegations come at a time of increased scrutiny over the management of federal disaster relief funds, particularly as FEMA has faced criticism for its response to recent natural disasters. The agency’s resources have been stretched thin across multiple emergencies, making proper stewardship of its funds a matter of public concern.

The scandal has prompted swift reaction from Republican colleagues in Congress. Representative Greg Steube of Florida announced plans to file a motion to censure Cherfilus-McCormick and remove her from all committee assignments.

“This is one of the most egregious abuses of public trust I have ever seen,” Steube stated on social media.

The Republican Party of Florida has called for Cherfilus-McCormick’s immediate resignation, describing the alleged actions as “absolutely disgusting” and demanding she “step down NOW!”

This is not the first time Cherfilus-McCormick has faced scrutiny over campaign finance issues. In 2023, the House Ethics Committee launched an investigation into allegations of campaign finance violations related to her 2022 election campaign, though the outcome of that probe remains unclear.

The Howard University graduate was re-elected to a third term in Congress earlier this month. She currently serves on the House Committee on Veterans’ Affairs and the House Committee on Foreign Affairs.

Cherfilus-McCormick’s office has not responded to requests for comment regarding the indictment.

The case highlights ongoing concerns about the oversight of federal emergency funds, particularly during crisis situations like the COVID-19 pandemic, when large sums were distributed quickly to address urgent needs. Government watchdogs have repeatedly warned about the vulnerability of emergency funding programs to fraud and misuse, especially when normal oversight procedures are expedited during disasters.

The indictment comes as part of broader efforts by the Justice Department to crack down on alleged fraud related to pandemic relief programs, with hundreds of cases being pursued nationwide involving billions in potentially misused federal funds.
