California Supreme Court Disbarrs Trump Attorney John Eastman Over 2020 Election Challenges

The California Supreme Court has officially disbarred John Eastman, a key legal adviser to former President Donald Trump during efforts to challenge the 2020 presidential election results.

“The California Supreme Court disbarred attorney John Charles Eastman today,” the State Bar of California announced in a statement released Thursday. The decision follows the State Bar Court Review Department’s July 2025 ruling that upheld findings from March 2024, which determined Eastman was culpable of 10 out of 11 charges for what was described as “egregious and deceitful conduct.”

Eastman played a significant role in Trump’s post-election legal strategy, most notably as the author of a controversial memo outlining how then-Vice President Mike Pence could potentially reject electoral votes for Joe Biden while presiding over the January 6, 2021, joint session of Congress. This legal strategy was part of a broader effort to keep Trump in office despite his election loss.

State Bar Chief Trial Counsel George Cardona emphasized the severity of the decision in his statement: “After extensive proceedings before the State Bar Court’s Hearing and Review Departments, both of which found Mr. Eastman culpable of serious ethical violations, the Court has imposed the discipline warranted by the clear and convincing evidence that he advanced false claims about the 2020 presidential election to mislead courts, public officials, and the American public.”

Cardona further emphasized that “the Court’s order underscores that Mr. Eastman’s misconduct was incompatible with the standards of integrity required of every California attorney.”

The disbarment represents one of the most significant professional consequences faced by any attorney involved in the legal challenges to the 2020 election. As a constitutional law scholar and former dean of Chapman University School of Law, Eastman’s fall from professional standing marks a dramatic turn in a once-distinguished legal career.

Eastman’s legal team has vowed to fight the decision. His attorney, Randall Miller, provided a statement to Fox News Digital indicating plans to appeal to the highest court in the land: “The California Supreme Court has allowed to stand a State Bar Court recommendation that we contend departs from long-standing United States Supreme Court precedent protecting First Amendment rights, especially in the attorney discipline context.”

Miller’s statement continued, “We disagree with that outcome and believe it raises pivotal constitutional concerns regarding the limits of state regulation of attorney speech. We will seek review in the U.S. Supreme Court to repudiate this threat to the rule of law and our nation’s adversarial system of justice.”

The case highlights ongoing tensions in the legal community about the proper boundaries of election-related litigation and attorney conduct. Legal ethics experts have been closely watching Eastman’s case, along with disciplinary proceedings against other attorneys who participated in post-election challenges, as potential precedent-setting matters that could reshape professional standards for attorneys engaged in politically sensitive litigation.

Eastman’s disbarment comes amid a broader landscape of legal and professional consequences for individuals involved in challenging the 2020 election results. Several other attorneys who worked on Trump-related election challenges have faced disciplinary actions across different states, though the penalties have varied significantly.

The White House has not yet commented on Eastman’s disbarment. Meanwhile, former President Trump has continued to question the integrity of the 2020 election, recently calling for a special prosecutor to investigate what he has characterized as “massive election fraud.”

Eastman’s legal battle is not over, with his appeal to the U.S. Supreme Court potentially setting the stage for a high-profile examination of First Amendment protections for attorneys and their professional conduct during politically charged legal disputes.
