Outrage Grows as California Professor May Avoid Prison in Fatal Protest Confrontation

Jewish community leaders and advocates have expressed deep concern after a Ventura County court indicated it would likely offer probation instead of prison time to a community college professor charged in the death of an elderly pro-Israel protester.

Loay Abdel Fattah Alnaji, 53, recently changed his plea in a case stemming from a November 2023 incident in Thousand Oaks, California, where he struck 69-year-old Paul Kessler with a megaphone during dueling demonstrations related to the Israel-Hamas conflict. According to medical examiners, Kessler fell backward after being struck, hitting his head on the ground, and later died in hospital from blunt force trauma.

The case has gained significant attention amid rising tensions and concerns about antisemitism across the United States following the outbreak of the Israel-Hamas war. Alnaji had initially faced up to four years in prison, but Ventura County Superior Court Judge Derek Malan has now indicated the defendant will likely receive formal probation with up to 365 days in county jail.

Ventura County District Attorney Erik Nasarenko publicly opposed the reduced sentence, stating, “Alnaji should be sentenced to prison for his violent behavior, and our office strongly objects to any lesser sentence.” He added that a prison term would better reflect the severity of the crime and serve as a deterrent to similar acts of violence.

The court’s decision has drawn intense scrutiny, particularly after Judge Malan reportedly characterized the incident as if “two old guys had a dispute and an accident happened,” according to defense attorney Ron Bamieh. This characterization has intensified criticism from those who view the case through the lens of rising antisemitism.

Jonathan Oswaks, a friend who attended the protest with Kessler, described the news as “deeply frustrating” in an interview with the Jewish Journal. He recounted the hostile atmosphere at the rally, where pro-Palestinian protesters allegedly used megaphones inches from protesters’ faces. “When I tell you I had never experienced that level of hate in my life, I hadn’t,” Oswaks said.

The Anti-Defamation League criticized the sentencing outcome, arguing it “emboldens others to act in anger against the Jewish community.” Meanwhile, Rabbi Noah Farkas, president of the Jewish Federation of Los Angeles, expressed measured disappointment, stating, “While we would have liked a harsher sentence,” he welcomed “the admission of guilt for this heinous crime.”

Defense attorney Bamieh has maintained that Alnaji made a “thoughtful decision” by changing his plea, citing concerns for his family and community peace. The defense has consistently argued that a pre-existing brain condition actually caused Kessler’s death, contradicting the medical examiner’s determination of blunt force trauma.

A source familiar with the defense’s position claimed the district attorney’s office was involved in sentencing discussions despite public statements expressing dissatisfaction. The source also contended that prior to the plea deal, the victim’s family wanted the case resolved quickly without a trial and did not strongly advocate for a specific sentence.

The defense has further disputed the prosecution’s narrative, claiming inconsistencies in eyewitness accounts about who was the aggressor during the confrontation. “For those who have characterized Mr. Alnaji as a violent man who intentionally struck a helpless victim, I simply say: they are either uninformed about the facts of this case, or they are pursuing an agenda unrelated to justice,” Bamieh stated.

The case highlights ongoing tensions surrounding protests related to the Israel-Hamas conflict and broader concerns about political violence in the United States. Alnaji remains free on $50,000 bail with sentencing scheduled for June 25.
