Wisconsin Redistricting Lawsuits Unlikely to Impact 2024 Election, Court Hearings Suggest
Two lawsuits challenging Wisconsin’s Republican-favoring congressional maps appear destined for resolution after the 2026 midterm elections, despite arguments from Democratic attorneys that new boundaries could be implemented before November’s contest.

Attorneys for Wisconsin’s six Republican congressmen advocated for a much longer timeline that would delay any trial until March 2027, well after the next midterm election cycle. Kevin LeRoy, representing the Republican lawmakers, argued that “seeking relief in time for the 2026 election would be unfair.”
The cases mark the first implementation of Wisconsin’s 2011 law requiring redistricting challenges to be heard by three-judge panels. The Wisconsin Supreme Court ordered this arrangement last month over Republican objections. The panel hearing the case brought by Wisconsin Business Leaders for Democracy tentatively set a trial date for April 2027, assuming the case survives dismissal motions.
Any rulings from these panels can be appealed to the Wisconsin Supreme Court, which currently has a 4-3 liberal majority.
The lawsuits present different but complementary arguments against the current maps. The bipartisan coalition of business leaders contends the congressional maps create anti-competitive districts, noting that the median victory margin across Wisconsin’s eight districts has approached 30 percentage points since implementation.
“In a 50-50 state, it makes no sense that 75% of Wisconsin seats in the House of Representatives are controlled by one party,” stated Law Forward, a legal organization supporting the lawsuit.
The separate case filed on behalf of Democratic voters argues the maps discriminate by concentrating Democratic voters into just two districts while dispersing other Democratic areas across six Republican-friendly districts.
The political impact of these maps has been significant. Before Republicans redrew the congressional boundaries in 2011, Democrats held five of Wisconsin’s eight House seats compared to Republicans’ three. Today, Republicans control six seats, with only two considered competitive.
The current maps, which are based on those drawn in 2011, were approved by the state Supreme Court when conservatives held the majority. The U.S. Supreme Court declined to block their implementation in March 2022.
Democrats have identified western Wisconsin’s 3rd District, currently represented by Republican Derrick Van Orden, as a prime target for potential redistricting. Van Orden won the seat in 2022 following Democratic Rep. Ron Kind’s retirement and secured reelection in 2024.
The southeastern 1st District, held by Republican Rep. Bryan Steil since 2019, is another district Democrats hope to make more competitive. While recent map adjustments made this district somewhat more balanced, it still favors Republicans.
With the courts appearing unlikely to intervene before this November’s election, Wisconsin voters will likely cast ballots under the existing congressional boundaries, maintaining Republicans’ structural advantage in the state’s congressional delegation for at least one more election cycle.
