False Claims Act Emerges as Key Tool for AI Enforcement in Federal Contracting

As artificial intelligence transforms industries across the United States, a significant enforcement gap is emerging. While comprehensive AI-specific federal regulations remain limited, the Department of Justice (DOJ) is increasingly turning to the False Claims Act (FCA) to police AI misuse in government contracting.

The FCA, a powerful quasi-penal statute that punishes knowingly submitting false claims for payment to the federal government, is becoming a central component in federal enforcement efforts against both developers and users of AI technologies. This trend affects not only companies that contract directly with the government but also subcontractors and businesses connected to government programs.

Legal experts recommend companies implement comprehensive AI governance procedures that emphasize pre-deployment testing, ongoing auditing, and validation of AI outputs. These programs should be designed with potential FCA exposure in mind, ensuring AI systems deliver on the representations made about them.

The financial stakes are substantial. The FCA’s per-claim penalty structure, combined with treble damages provisions, means a single enforcement action can result in millions or even billions in liability. For companies in the healthcare sector, where thousands of claims might be submitted daily, the exposure is particularly acute.

As federal agencies continue developing AI-specific guidance, the compliance landscape will likely become even more complex. Organizations should work with experienced counsel to navigate this evolving regulatory environment and implement appropriate oversight mechanisms to mitigate FCA risk.

With both DOJ enforcement priorities and financial incentives for private whistleblowers (known as “relators”) driving increased scrutiny, companies utilizing AI in government-adjacent activities face a critical compliance challenge. Proactive risk assessment and governance will be essential as AI adoption accelerates across federally funded programs and procurement activities.
