A Wicklow man facing charges over false claims about an asylum seeker must enter a plea at his next court appearance, a judge ruled Monday.
Kirk Loco (44), from Waverly Meadow in Rathnew, Co Wicklow, stands accused of distributing threatening or grossly offensive communication about a resident of an IPAS (International Protection Accommodation Service) center. The alleged offense stems from a social media post published on June 21st, 2024.
During proceedings at Bray District Court, Judge Áine Shannon heard that “quite extensive disclosure” related to the case would be provided to the accused within a week.
The defendant’s legal representative, Sorcha Dianamh Ní Néill Fulham BL, applied for free legal aid, arguing that despite Loco’s employment and weekly salary of €700, he faced “substantial” mortgage repayments. Judge Shannon granted the application, backdating it to his first court appearance on November 3rd, noting there was no objection from the prosecution and that Loco had provided a statement of means.
The judge remanded Loco on continuing bail until February 16th, 2026, when he must enter a plea or have a date set for a hearing. Approximately ten supporters accompanied the accused to court.
Loco is charged under Section 4 (1) and 4 (3) of the Harassment, Harmful Communications and Related Offences Act 2020, commonly known as “Coco’s Law.” This legislation was enacted following the death of Nicole “Coco” Fox, who died by suicide in 2018 after experiencing severe online abuse and bullying. The law aims to combat harmful digital communications and protect individuals from online harassment.
According to court documents, the post in question falsely claimed that an intoxicated migrant residing at Trudder House in Newtownmountkennedy, Co Wicklow, had exposed himself to a 14-year-old girl on a 133 bus the previous evening. The social media post included a photograph of a male asleep on a bus and encouraged others to share information about the alleged incident.
The content also suggested that community members who welcomed asylum seekers or promoted integration efforts were culpable, going so far as to accuse them of “cheering on pedophilia [sic].” The post reportedly tagged several high-profile anti-immigrant activists, potentially amplifying its reach and impact.
At a previous court appearance last month, the court heard that Loco made no reply when charged after being cautioned. Gardaí had also requested bail conditions requiring the accused to avoid IPAS centers and refrain from attending demonstrations or protests related to immigration issues.
This case emerges amid increasing tensions surrounding immigration and asylum accommodation in Ireland, with social media increasingly becoming a battleground for misinformation.
