In a controversial move that highlights ongoing tensions over the 2020 election, President Donald Trump issued a symbolic pardon Thursday for Tina Peters, the former Colorado county clerk currently serving a nine-year prison sentence. The gesture, while politically significant, carries no legal weight as presidential pardons cannot be applied to state convictions.

Peters was found guilty last year on multiple charges related to a security breach of her county’s election system. As the Mesa County clerk and recorder, she allowed an unauthorized individual with connections to MyPillow CEO Mike Lindell to access secure election equipment using a security card and then misrepresented that person’s identity to officials.

“Democrats have been relentless in their targeting of TINA PETERS, a Patriot who simply wanted to make sure that our Elections were Fair and Honest,” Trump wrote in a social media post announcing the symbolic action. The statement repeated his continued assertions of election fraud that have been repeatedly debunked.

The case has become a flashpoint in the ongoing national debate about election security and voter fraud claims. Peters, who has remained defiant about her actions, has become an icon among those who believe conspiracy theories about the 2020 presidential election, despite extensive evidence to the contrary.

Numerous courts across the country, including judges appointed by Trump himself, found no credible evidence of widespread fraud that could have altered the election outcome. Trump’s own Attorney General William Barr publicly stated there was no evidence of fraud at a scale that would have changed the results. Additionally, multiple recounts, audits, and reviews in battleground states confirmed President Biden’s victory.

Legal experts note that the presidential pardon power is explicitly limited to federal offenses. Under the U.S. Constitution, presidents cannot pardon state crimes, making Trump’s action purely symbolic without any practical effect on Peters’ incarceration.

This pardon follows similar symbolic gestures Trump made last month for several allies facing state charges related to efforts to overturn the 2020 election results, including his former personal attorney Rudy Giuliani and former chief of staff Mark Meadows.

Peters’ legal team has pursued multiple avenues to secure her release. The Trump administration previously attempted to have her transferred from state to federal prison—a move opposed by Colorado officials. Just this week, a federal magistrate judge rejected Peters’ request to be released while she appeals her state conviction.

The security breach orchestrated by Peters was particularly concerning to election security experts because it involved compromising the chain of custody for sensitive voting equipment. Prosecutors successfully argued that her actions were motivated by unfounded conspiracy theories and represented a serious breach of public trust.

Colorado Secretary of State Jena Griswold, who had to decertify the compromised voting equipment following the breach, has previously stated that Peters’ actions cost Mesa County taxpayers hundreds of thousands of dollars and undermined public confidence in elections.

The symbolic pardon serves as a reminder of the deep political divisions that continue to surround the 2020 election and the ongoing influence of election denial narratives among certain segments of the electorate. As the 2024 presidential election approaches, election officials across the country have expressed concern about the lasting impact these narratives may have on public trust in the electoral process.

Peters remains incarcerated in Colorado, with her legal appeals continuing through the state court system.
