In a significant crackdown on alleged online misinformation, the Malaysian Communications and Multimedia Commission (MCMC) has launched an investigation into a TikTok user accused of spreading false content involving Malaysia’s top anti-corruption official.
The investigation targets content uploaded to the popular social media platform TikTok that allegedly contains false information about the Malaysian Anti-Corruption Commission (MACC) and its chief commissioner, Azam Baki. According to an MCMC statement released yesterday, authorities have already recorded a statement from the suspect and seized a communication device believed to have been used to upload the controversial content.
“The case is being investigated under Section 233 of the Communications and Multimedia Act 1998,” the commission stated. If convicted, the TikTok user could face severe penalties, including a maximum fine of RM500,000 (approximately US$106,000), imprisonment for up to two years, or both.
The MCMC, Malaysia’s primary telecommunications and digital media regulator, emphasized its firm stance against social media misuse. “We view seriously any misuse of social media and digital platforms intended to mislead the public through the spread of false information,” the commission declared, warning that “firm enforcement action will be taken against any person found to have breached existing laws.”
This investigation comes at a sensitive time for Malaysia’s anti-corruption efforts. Azam Baki, who has led the MACC since 2020, has faced his own share of controversies, including allegations of improper share ownership that emerged in 2021. Though he was eventually cleared by the Securities Commission, the case highlighted the scrutiny faced by public officials in Malaysia’s ongoing battle against corruption.
Malaysia has been intensifying efforts to combat online misinformation in recent years. The Southeast Asian nation, with its diverse population of 33 million and high digital penetration rate, has seen social media become a powerful force that can both inform and potentially destabilize.
Digital rights advocates have previously expressed concerns about the broad scope of Section 233, which criminalizes “improper use of network facilities” including initiating communications that are “obscene, indecent, false, menacing or offensive in character with intent to annoy, abuse, threaten or harass another person.” Critics argue the law’s wide-ranging language could potentially stifle legitimate speech and criticism.
TikTok, owned by Chinese company ByteDance, has over 4 million users in Malaysia and has grown increasingly influential, particularly among younger Malaysians. The platform has faced regulatory scrutiny in multiple countries over concerns ranging from data security to content moderation.
In its statement, the MCMC also issued a broader warning to the Malaysian public, advising citizens to “act responsibly when using social media and digital platforms, and not to abuse communication tools to upload or disseminate content that could undermine social harmony and public order.”
The commission did not provide specific details about the false content that prompted the investigation or reveal the identity of the TikTok user under investigation. It also remains unclear whether the content in question was politically motivated or simply misinformation.
Malaysian authorities have indicated this case serves as a reminder that digital platforms, while providing spaces for expression and connection, remain subject to the country’s legal framework regarding false information and defamatory content.
