In a shocking development, police in Bengaluru have determined that a nursing student’s gang-rape accusation against a cab driver was fabricated to conceal a consensual encounter from her boyfriend. The case, which initially triggered swift police action, has now raised serious questions about false accusations and their consequences.

The 22-year-old nursing student from Kerala filed a complaint on December 6 at Madiwala police station, claiming she had been gang-raped by a cab driver and several accomplices inside a vehicle near Sir M Visvesvaraya Terminal four days earlier, on the night of December 2.

Following standard protocol for such serious allegations, police quickly registered a gang-rape case and transferred it to Banaswadi police station due to jurisdictional considerations. Senior officers were immediately briefed, and based on the student’s statement, authorities arrested the accused driver at his residence in east Bengaluru.

The 33-year-old driver, a father of two married to a homemaker, was reportedly shocked by the allegations. Throughout his detention and questioning, he consistently maintained his innocence, a claim that would later be vindicated by evidence.

As investigators began examining CCTV footage from the railway station, they discovered a very different narrative than what had been reported. The surveillance recordings showed the nursing student and the cab driver together at the railway station between 11:30 PM on December 2 and 5:30 AM on December 3. The footage clearly captured them exiting the cab together, re-entering the vehicle during the night, and later walking around the station premises.

Furthermore, investigators were unable to locate any evidence of the “gang members” the student had mentioned in her complaint. The footage showed the woman eventually boarding the Ernakulam train after 5:30 AM on December 3, with no signs of distress.

In a decisive turn for the investigation, authorities examined the cab driver’s mobile phone and discovered numerous WhatsApp messages sent by the nursing student starting from December 3. These messages not only suggested a consensual interaction had occurred but also indicated an amicable relationship between them even after the encounter. The digital evidence directly contradicted the narrative of a forced assault.

When confronted with these inconsistencies, police summoned the woman for further questioning. Under pressure from the mounting evidence, she admitted to filing a false complaint. According to her confession, she had fabricated the gang-rape story to avoid her boyfriend’s questions about scratch marks on her neck, which had occurred during her consensual encounter with the cab driver.

The driver provided further context, explaining that he was familiar with the student because they both hailed from Kerala. He stated that he had driven her to the railway station that night as part of his regular service. According to his account, after entering his cab, the nursing student had called her boyfriend in Ernakulam to inform him she would be catching the early morning train.

This case highlights the serious implications of false allegations in sexual assault cases. While the driver has been vindicated by evidence, he has already endured arrest, detention, and potential damage to his reputation and livelihood. As a father of two dependent children with a homemaker wife, the economic and social impact on his family has been significant.

The investigation remains ongoing, with authorities now considering the appropriate legal response to the false complaint. The case serves as a stark reminder of the critical importance of thorough investigation and the presumption of innocence until proven guilty, even as society rightfully prioritizes taking sexual assault allegations seriously.

Police officials have not yet commented on whether the nursing student will face charges for filing a false report, a crime that carries potential penalties under Indian law.
