Los Angeles County DA Vows to Prosecute Fraudulent Sex Abuse Claims in Billion-Dollar Settlement

Los Angeles County District Attorney Nathan Hochman issued a stern warning to those attempting to exploit the county’s massive settlement for sex abuse survivors, promising aggressive prosecution of individuals filing fraudulent claims.

“They looked at this opportunity to compensate these true victims of sex abuse as an opportunity to personally profit and engage in some of the most greedy and heinous conduct at the expense of these victims,” Hochman said in a recent statement addressing the issue.

The DA’s office is scrutinizing thousands of claims that have flooded the system following the passage of Assembly Bill 218 (AB 218), which opened a window for victims to come forward with allegations dating back to the 1950s. Earlier this year, Los Angeles County approved an $828 million settlement with 414 plaintiffs alleging childhood abuse by county workers. This agreement follows a previous $4 billion settlement covering approximately 11,000 claimants.

The financial implications of these settlements are profound, according to Hochman. “AB 218 — it is going to control the financial health of every county, every city and every school district for the next 25 to 30 years,” he explained, highlighting the long-term fiscal impact on local government entities throughout California.

A significant challenge facing investigators is the verification of decades-old claims. Hochman noted that juvenile records are typically destroyed after ten years, making it extremely difficult to corroborate or contest allegations from 20, 30, or 40 years ago.

“So when these lawsuits came in saying that this had happened 20, 30, 40 years ago, there was no way, effectively, to defend against these lawsuits because we couldn’t contest any of these claims,” Hochman said, explaining how the absence of documentation creates vulnerability to potential fraud.

While the DA acknowledges that thousands of legitimate victims exist, his office is determined to identify those attempting to capitalize on the settlement through deception. Hochman has offered a limited amnesty program for individuals who have already submitted false claims, encouraging them to come forward and cooperate with authorities.

“We’re going to go after them aggressively. We’re going to go after them to put them behind bars,” Hochman warned potential fraudsters, making clear the serious legal consequences of submitting fraudulent claims.

The settlements stem from decades of alleged abuse within Los Angeles County facilities, including juvenile detention centers, foster care placements, and other county-operated institutions. The cases represent one of the largest settlements for institutional child abuse in American history.

Legal experts note that large settlements like these often attract fraudulent claims, particularly when verification processes are hampered by time and missing records. Similar challenges have occurred in other large-scale abuse settlements nationwide, including those involving religious institutions and youth organizations.

While Hochman declined to detail specific investigative methods his office is employing to identify potentially fraudulent claims, he indicated that certain patterns and inconsistencies raise red flags during the review process.

The DA’s crackdown comes amid growing concern about the fiscal impact these settlements will have on county services. Los Angeles County, home to over 10 million residents, faces significant budgetary challenges as it works to fulfill these settlement obligations while maintaining essential public services.

Victim advocates have expressed support for thorough verification processes while emphasizing that the vast majority of claims represent genuine trauma experienced by survivors. They stress that rooting out fraudulent claims helps ensure resources reach those who truly suffered abuse under county care.

The investigation continues as county officials work with claimants’ attorneys to process the thousands of outstanding cases covered under the settlements.
