ICC Legal Team Denies Reports of Duterte’s Unconsciousness in Detention

Nicholas Kaufman, the legal counsel for former Philippine President Rodrigo Duterte, has firmly rejected circulating online rumors claiming that Duterte was found unconscious in his cell at the International Criminal Court (ICC) detention facility in The Hague, Netherlands.

“I would like to state, in no uncertain terms, that the information circulating on the internet suggesting that Former President Duterte was found unconscious in his cell this morning is totally untrue,” Kaufman stated in a message that was subsequently shared by Vice President Sara Duterte, the former president’s daughter.

Kaufman emphasized that he had recently spoken with the former Philippine leader, who he described as “stoically awaiting the judgment of the ICC Appeals Chamber on the matter of interim release.”

The 79-year-old Duterte is currently being held at the Scheveningen Prison, a detention facility in The Hague that houses individuals facing trial at international tribunals. His detention stems from charges of alleged crimes against humanity related to his controversial war on drugs campaign, which he implemented first as mayor of Davao City and later expanded nationwide during his presidency from 2016 to 2022.

Human rights organizations estimate that between 6,000 and 30,000 people were killed in extrajudicial killings during Duterte’s anti-drug campaign, though official government figures are significantly lower. The ICC’s focus on Duterte represents one of its most high-profile cases involving a former head of state.

The ICC Appeals Chamber is scheduled to announce its decision on Duterte’s appeal for interim release on November 28. This ruling follows the ICC Pre-Trial Chamber I’s September 26 decision to deny his initial request for temporary freedom while proceedings continue.

According to ICC officials, the upcoming decision will be delivered in open court at 10:30 a.m. local time in The Hague and will be broadcast live through the tribunal’s official website as well as its social media channels, including Facebook and YouTube.

The case has drawn significant international attention and remains a polarizing issue in the Philippines, where Duterte maintained high approval ratings throughout his presidency despite international criticism of his human rights record.

The Philippines withdrew from the ICC in 2019 under Duterte’s administration, but the court maintains it has jurisdiction over crimes allegedly committed while the country was still a member. Current Philippine President Ferdinand Marcos Jr. has maintained his predecessor’s position that the ICC no longer has jurisdiction over Philippine affairs.

Legal experts note that the outcome of Duterte’s appeal could set important precedents for how the ICC handles detention decisions for former heads of state. The court must balance considerations of flight risk and potential interference with investigations against the rights of the accused and practical diplomatic considerations.

The spread of false information regarding Duterte’s condition highlights the charged atmosphere surrounding the case and the continuing polarization of Philippine politics regarding his legacy. Social media platforms have become battlegrounds where supporters and critics spread competing narratives about the former president’s situation.

Vice President Sara Duterte, who continues to serve in the current administration despite being the daughter of the detained former president, has been careful to maintain a balance between her governmental responsibilities and family loyalties during this legal crisis.

As the November 28 ruling approaches, security measures around the ICC facility are expected to be heightened, with both supporters and opponents of the former president potentially gathering outside the court to await the decision.
