Police in Kyle, Texas, are searching for a man who allegedly fabricated a child’s death and created a fraudulent fundraiser to collect money from unsuspecting donors.

Authorities have identified the suspect as 41-year-old Cody Allen Vance, who is now wanted on a felony charge of theft by deception. According to Kyle Police Department officials, Vance allegedly claimed his 10-year-old nephew had died in a car accident and then organized an online fundraiser to exploit public sympathy.

The investigation began when concerned citizens contacted police after noticing suspicious inconsistencies in Vance’s story. Detectives uncovered that no such accident had occurred, and the child Vance claimed had died is actually alive and well.

“This is one of the most disturbing cases of fraud we’ve encountered,” said Kyle Police Chief Jeff Barnett. “To fabricate the death of a child for financial gain shows an extraordinary lack of moral character and causes real harm to the community’s trust in legitimate fundraising efforts.”

Investigators revealed that Vance had collected an undisclosed amount of money through various payment platforms before the scheme was discovered. Police believe multiple people donated to the fraudulent cause, thinking they were helping a family cope with funeral expenses and other costs associated with the loss of a child.

The case highlights the growing problem of crowdfunding fraud, which has become increasingly common with the proliferation of online fundraising platforms. According to the Federal Trade Commission, Americans lost more than $621 million to various forms of impostor scams in 2022, with a significant portion coming from fraudulent charity and fundraising efforts.

“These types of scams not only victimize individual donors but can also have a chilling effect on legitimate charitable giving,” said consumer protection attorney Meredith Simmons, who specializes in digital fraud cases. “When people hear about cases like this, they become more hesitant to contribute to genuine causes, which hurts those who truly need assistance.”

Law enforcement agencies recommend potential donors verify the legitimacy of fundraisers before contributing by contacting organizers directly, checking for inconsistencies in the story, and researching whether the claimed incident actually occurred through local news reports.

Kyle, a growing city located between Austin and San Marcos in the Texas Hill Country, has seen its population more than double in the last decade to over 50,000 residents. As the community has expanded, local authorities have noted an increase in various fraud schemes targeting its residents.

Police are asking anyone with information about Vance’s whereabouts to contact the Kyle Police Department. They also urge anyone who may have donated to his fraudulent fundraiser to come forward, both to assist in the investigation and to potentially recover their money.

If convicted of theft by deception, Vance could face significant penalties. In Texas, theft charges are classified based on the amount stolen, with penalties ranging from misdemeanors to felonies carrying prison sentences of up to 10 years and substantial fines.

“We take these cases very seriously,” said Hays County District Attorney Kelly Higgins. “Exploiting people’s compassion and generosity, particularly by inventing a child’s death, represents a particularly callous form of fraud that deserves appropriate consequences.”

As the search for Vance continues, community leaders have emphasized the importance of supporting legitimate charitable causes while remaining vigilant against potential scams.
