The Justice Department secured a significant legal victory on Wednesday when a U.S. judge ruled it can retain 2020 election ballots seized during an FBI search in January, advancing the Trump administration’s continued investigation into alleged voter fraud claims that have persisted since the former president’s 2020 defeat.
U.S. District Judge J.P. Boulee in Atlanta rejected Fulton County’s request for the return of original ballot materials seized during the FBI’s search of the county’s election hub. County lawyers had argued that the search was based on discredited evidence and violated constitutional protections.
While acknowledging flaws in the FBI’s search warrant affidavit, Judge Boulee determined in his 68-page ruling that these shortcomings did not constitute “callous disregard” for the county’s rights – the legal threshold that would have required the materials to be returned.
“While the Affidavit was certainly far from perfect, this is not a situation where an officer left out all the facts that might undermine probable cause or where an officer intentionally lied,” Boulee wrote.
Fulton County Chairman Robb Pitts expressed disagreement with the ruling and stated that the county plans to “vigorously” pursue all available legal options. The FBI and Justice Department did not immediately respond to requests for comment.
The ruling represents a rare court win for Trump-directed Justice Department investigations and allows federal authorities to maintain possession of more than 600 boxes of 2020 ballots. The FBI is investigating whether election records were improperly retained and if Fulton County residents were deprived of a fair election.

Biden’s substantial margin in Fulton County proved crucial to flipping Georgia to Democrats in 2020, though the state returned to Trump’s column in 2024.
During court proceedings, Fulton County lawyers argued that the FBI affidavit justifying the search omitted essential context showing that many of its claims had previously been investigated and found to be either unfounded or mistakes not resulting from intentional misconduct.
