In a legal challenge that highlights growing concerns about AI accuracy, conservative activist Robby Starbuck filed a lawsuit against Google on Wednesday, alleging the tech giant’s artificial intelligence systems generated false and defamatory information about him.
According to the lawsuit filed in Delaware state court, Google’s AI systems falsely labeled Starbuck as a “child rapist,” “serial sexual abuser” and “shooter” in response to user queries. Starbuck claims these defamatory statements were delivered to millions of users, causing significant harm to his reputation.
Google spokesperson Jose Castaneda responded that most of the claims were related to mistaken “hallucinations” from Google’s Bard large language model that the company addressed in 2023. “Hallucinations are a well-known issue for all LLMs, which we disclose and work hard to minimize,” Castaneda said. “But as everyone knows, if you’re creative enough, you can prompt a chatbot to say something misleading.”
Starbuck, known for his opposition to diversity, equity and inclusion initiatives, stated that the issue transcends political affiliations. “No one — regardless of political beliefs — should ever experience this,” he said. “Now is the time for all of us to demand transparent, unbiased AI that cannot be weaponized to harm people.”
This isn’t Starbuck’s first legal battle against a tech giant over AI-generated content. He made similar allegations against Meta Platforms in a separate lawsuit filed in April. That dispute was settled in August, with Starbuck subsequently advising Meta on AI issues as part of the settlement agreement.
The complaint details that Starbuck first discovered issues in December 2023 when Google’s Bard falsely connected him with white nationalist Richard Spencer, citing fabricated sources. According to the lawsuit, Google failed to address these false statements after Starbuck contacted the company.
More recently, Starbuck alleges that Google’s Gemma chatbot disseminated false sexual assault allegations against him in August, again based on fictitious sources. The lawsuit further claims the chatbot falsely stated that he committed spousal abuse, attended the January 6 Capitol riots, and appeared in the Jeffrey Epstein files, among other accusations.
These allegations highlight the growing concern about AI’s potential to spread misinformation. AI hallucinations—when AI systems generate fabricated or inaccurate information presented as fact—have become a significant issue for technology companies as they race to deploy increasingly sophisticated generative AI systems.
