Legal Consequences Mount as Trump Ally John Eastman Disbarred in California
John Eastman, a central legal architect in former President Donald Trump’s attempts to overturn the 2020 election results, has been officially disbarred in California following a decision by the state’s Supreme Court on Wednesday.
The ruling upholds a 2024 recommendation from State Judge Yvette Roland, who concluded that Eastman “exhibited gross negligence by making false statements about the 2020 election without conducting any meaningful investigation or verification of the information he was relying upon.” The state’s highest court denied Eastman’s request for review and ordered his name “stricken from the roll of attorneys” while also imposing a $5,000 fine payable to the state bar.
Eastman, who once served as a clerk for Supreme Court Justice Clarence Thomas, played a pivotal role in developing the controversial “fake elector” strategy that formed the foundation of Trump’s post-election challenges. This theory proposed that then-Vice President Mike Pence had the authority to reject certified electoral votes during the congressional certification process – a position rejected by constitutional scholars and ultimately by Pence himself.
Legal experts view the disbarment as a significant development in the ongoing accountability process for lawyers who participated in efforts to challenge the 2020 election outcome.
“Eastman played a central role in the plot to overturn the 2020 election – pressuring state officials, advancing baseless claims in court, and promoting a fringe theory that the vice-president could reject certified electoral votes,” said Christine Sun, senior vice-president of legal at States United Democracy Center, which initiated the original complaint against Eastman. “His unethical actions have had real, lasting consequences for our democracy.”
Eastman’s legal team has indicated they plan to appeal the decision to the United States Supreme Court, arguing that the disbarment raises “pivotal constitutional concerns regarding the limits of state regulation of attorney speech,” according to reporting from Politico.
The California disbarment adds to Eastman’s mounting legal troubles. His law license has also been suspended in Washington DC, and he faces criminal charges in Arizona related to his post-election activities. While similar charges in Georgia were previously dropped, the Arizona case remains active.
The disciplinary action against Eastman reflects a broader pattern of professional consequences for attorneys who supported Trump’s election challenges. Rudy Giuliani, Trump’s personal attorney who spearheaded numerous unsuccessful legal challenges contesting the election results, has been disbarred in both New York and Washington DC. Similarly, Kenneth Chesebro, another key figure in developing the alternate electors strategy, lost his license to practice in New York.
Jeff Clark, a former Justice Department official who allegedly supported efforts to use the department to overturn election results, also faces a recommendation for disbarment in Washington DC.
Legal watchdog organizations have actively pursued bar disciplinary proceedings as a mechanism for professional accountability, separate from criminal prosecutions related to the events following the 2020 election.
“This decision is part of a broader reckoning for those who seek to undermine the rule of law in this country,” Sun noted. “While Trump tries to consolidate power, the states and courts continue to successfully check executive overreach and the unlawful actions of his administration.”
The disbarment represents one of the most severe professional penalties available for attorneys and effectively ends Eastman’s legal career in California unless successfully appealed. Legal ethics experts note that disbarment cases related to election challenges are relatively rare in American legal history, underscoring the exceptional nature of the post-2020 election period and the legal profession’s response to perceived ethical violations during that time.

That’s a good question. Disbarment is an important first step, but it will be interesting to see if any further criminal or civil charges are pursued as well.
