Former Hialeah Council Member Sentenced to Probation in Insurance Fraud Case
A former Hialeah City Council member avoided incarceration Thursday when a federal judge sentenced her to three years of probation for making false statements to authorities in connection with a multimillion-dollar health insurance fraud scheme.
Angelica Pacheco, who was elected to the Hialeah City Council in November 2023, must also pay $54,946 in restitution as part of her sentence. The punishment comes after she pleaded guilty earlier this year to a charge of making false statements.
The case marks a significant fall from grace for the newly elected official, whose political career was cut short just months after taking office. Pacheco was initially charged with eight counts related to healthcare fraud and had faced up to five years in prison, three years of supervised release, and fines of up to $250,000.
Federal prosecutors alleged that Pacheco’s now-defunct addiction treatment center, Florida Life Recovery and Rehabilitation, submitted more than $19 million in fraudulent claims to several insurance companies over a three-year period. The scheme, detailed in a grand jury indictment, targeted private insurers who were billed for services that were either never provided or significantly misrepresented.
Healthcare fraud has become an increasing concern in South Florida, which has emerged as an epicenter for insurance schemes, particularly in addiction treatment and rehabilitation services. The region has seen numerous similar cases in recent years as authorities crack down on fraudulent billing practices that drive up healthcare costs nationwide.
Following the charges, Pacheco surrendered to FBI agents in early 2024 and was subsequently suspended from her council position by Florida Governor Ron DeSantis, who has authority to remove elected officials charged with serious crimes.
During Thursday’s sentencing hearing, an emotional Pacheco addressed the court, detailing the personal consequences she has already faced. The judge acknowledged Pacheco’s difficult life circumstances, including being a child bride at 14 who was taken to Alabama to marry a significantly older, abusive man. Court records indicated she had multiple children before turning 19 and has struggled with mental health issues.
Despite these mitigating factors, the judge emphasized that Pacheco’s troubled past did not justify her criminal behavior. The court rejected prosecutors’ recommendation of just one year of probation, opting instead for a three-year supervisory period. The judge did, however, leave open the possibility of early termination after one year if Pacheco complies with all conditions.
As part of her sentence, Pacheco must maintain full-time employment but is barred from working in the substance abuse industry or being self-employed—restrictions aimed at preventing similar violations in the future.
Speaking to reporters briefly after the hearing, Pacheco expressed gratitude for support from her family, defense team, and community members. She also revealed that the case had left her “broken,” resulting not only in the loss of her council position but also causing her husband to lose his business due to negative publicity surrounding the charges.
The case highlights ongoing concerns about fraud in the healthcare industry, particularly in addiction treatment services where vulnerable patients and complex billing practices can create opportunities for exploitation. Federal authorities have increased scrutiny of such facilities throughout Florida in recent years, leading to numerous prosecutions of facility owners and operators.
Pacheco’s sentencing brings partial closure to a case that shocked Hialeah’s political establishment and raised questions about vetting processes for local political candidates. The city has not yet announced plans for filling her vacant council seat.
